The Planning Agency finds and determines as follows: A. That a proper application, (Use Permit 82-30), has been filed on behalf of Texaco, Inc. to authorize the reconstruction of an existing service station site to two fueling service islands with a convenience store and self-serve carwash. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The proposed use is in conformance with the Tustin Area General Plan. 2 . The proposed use i s i n conformance with the C i ty of .Tustin Zoning Ordinance, as amended. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject project, nor to the general welfare of the city of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the requirements of the California Environmental Quality Act. G. The Planning Agency hereby approves Conditional Use Permit No. 82-30, to authorize the reconstruction of an existing service station site to two fueling service islands with a convenience store and self-service carwash, subject to the fol 1 owing condi ti ons: A. The final site or grading plans should show the existing locations of the water service and the sanitary sewer lateral. .. B. Street lights will be required. Please provide three sets of prints of the site plan for this project so that a street light layout may be determined. C. Street trees will be required. Tree well locations should be shown on the final site or grading plan. D. Any damaged street improvement will require replacement. These improvements will include, but not be limited to, the following' a. Curb~ and gutter b. Si dewal k c. Drive aprons E. Grading plans and soils report .by a registered civil engineer are required. F. The use and type of construction of the proposed structures shall be indicated on the drawing. G. The food mart and related sanitary facilities shall, in all respects, be accessible to and useable by physically handicapped persons. Construction shall be in accordance with the requirements of the new state building code, Part 2, .Title 24 of California Administrative Code. It is suggested to relocate the door of the restroom and not to open through the storage room. H. The building shall comply with Title 24 for energy conservation, all prevailing technical codes, City ordinances and state laws. I. Approval from the Orange County Health Department is required prior to issuance of the building permit. lO 12 13 14 15 16 17 18 19 2O 21 Resolution No. J69 November 15, 1982 Page 3 J. The plans shall be signed by state-registered architect and/or civil engineer. K. Maintain all current safety features including adequate fire extinguishers, visible "Emergency Shut Off" sign and switch, twelve (12) foot vent piping clear of building, "No Smoking, Stop Motor" signs. L. Texaco shall provide leakage test on underground tanks and piping witnessed by Fire Department. M. The carwash activity shall conform to the noise standards" of the Tustin City Code. The sound attenuation features of the carwash shall be designed by a licensed acoustical engineer to include the rear property wal 1. N. The block wall shall be a minimum of 6'-8". O. The freeway identification sign shall be no more than fifty (50) feet in height and 204 square feet in area. The pole color shall match the exterior colors of the carwash and convenience store. P. The Newport Avenue Pole sign shall be no more than fifteen (15) feet in height and thirty-two (32) square feet in area, plus pricing signs. A pole cover shall be provided for this sign. Q. All wall signs shall conform to the City of Tustin Si gn Ordinance. R. Permits are required for all signs.
