HomeMy WebLinkAboutPC RES 20681 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 follows' RESOLUTION NO. 2068 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN RECOMMENDING TO THE CITY COUNCIL' DISPOSITION OF A PORTION OF ALLEY RIGHT-OF-WAY BETWEEN EL CAMINO REAL AND "C" STREET AND NORTHERLY OF SECOND STREET The Planning Agency of the City of Tustin does hereby resolve as 1. The Planni'ng Agency finds and determines as follows' a. That a proper application was filed by the property owners to the Planning Agency for the purpose of determining the needs, if any, of public right-of-way known as a portion of an alley between E1 Camino Real and "C" Street and northerly of Second Street as described by Exhibit "A" attached hereto and incorported herein by this reference as set forth herein in full. b. That the subject property should be declared excess to the City's needs and disposed of for private development for the following, reasons: (1) The alignment and configuration of the alley has been established with the approved site plan for the development at 175 "C" Street and 170 E1 Camino Real. (2) The property is not suitable nor adequate for other public purposes, such as parks or recreational needs. (3) There is no known use of the property as alley right-of'way. c. That pursuant to Section 8330 of the Streets and Highways Code for the State of California, it is possible to reserve public interest in easements for sewers, storm drains, and utility purposes. d. That the Agency recommends the vacation of the easement for alley purposes to the adjoining property owners without fee. e. Subject project is categor, ical l~v exempt from the California Environmental Qual i ty Act. f. That the vacation of the subject alley right-of-way will be in Conformance with the City of Tustin General Plan. 10 14 15 17 18 20 24 27 2. The Planning Agency, pursuant to Sections 37350 and 65402 of the Government Code, hereby recommends to the City Council the declaration of the subject parcel as excess to the needs of the City and its disposition to the adjoining property owners with the reservation of easements to conduct, maintain, operate, replace, remove, and renew those facilities necessary for storm drains, sewers, and public utilities.
