HomeMy WebLinkAboutPC RES 2010lO 13 14 15 17 18 20 24 25 27 RESOLUTION NO. 2010 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AUTHORIZING USE OF THE C. E. UTT INTERMEDIATE SCHOOL SITE FOR A CHURCH AND PRIVATE SCHOOL FACILITY The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application (Use Permit No. 81-33) has been filed on behalf of Colonial Bible Church to operate a church and pri- vate school at the C. E. Utt Intermediate School site at 13601 Browning Avenue. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimen- tal to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such pro- posed use, evidenced by the following findings: 1. This use is in conformance with the Land Use Element of the Tustin Area General Plan and with the Public & Institutional District of the Zoning Code. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by Orange County Fire Marshal, and street improve- ment requirements as administered by the City Engineer. F. This project is categorically exempt from the requirements of the California Environmental Quality Act.. G. Final development plans shall require the review and approval of the Community Development Department. II. The Planning Agency hereby adopts Use Permit No. 81-33 to authorize operation of a church and private school at 13601 Browning Avenue, as applied for, subject to the following conditions' A. That an improved parking area for one hundred (100) automobiles shall be constructed on-site within six (6) months of the date of this resolution and that the applicant shall provide the City surety bond to cover the construction cost of the improved park- i ng area. That use of the existing structures shall be in conformance with the Uniform Building Code and any modifications of the structures shall be done in accordance with Building Code regulations. D. That the applicant shall provide for the parking of congregation vehicles in the playground areas until the improved parking lot is completed.
