RESOLUTION NO. 1974
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, AMENDING A USE PERMIT TO CONSTRUCT A
MULTIPLE BUILDING OFFICE COMPLEX IN THE R-3
DISTRICT
The Planning Agency of the City of Tustin hereby resolves as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application to amend Use Permit 80-1 was
filed by Gfeller Development Company to request
authorization to construct a multiple office complex of
48,697 square feet gross floor area, on the Stevens
property at 228 West Main Street.
B. That a public hearing was. duly called, noticed, and held on
said application.
C. That establishment, maintenance and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the
following findings:
The proposal and application 'is in conformance with
provisions of Section 922662 of the City Code.
D. That the establishment, maintenance and operation of the
use applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the
subject property, nor to the general welfare of the City of
Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Code as administered by the building official,
Fire Code as administered by the Orange County Fire
Marshal, and street improvement requirements as
administered by the City Engineer.
F. That a Negative Declaration has been applied for to comply
with the requirements of the California Environmental
Quality Act and is hereby granted.
G. Final development plans shall require the review by the
Planning Agency and approval by the Community Development
Di rector.
II. The Planning Agency hereby grants a use permit as applied for,
to authorize the development of a 48,697 square foot (gross),
multiple building office complex subject to the following
conditions:
A. The development shall provide no less than 162 parking
spaces which shall be in substantial conformance with
current development standards. All requi red parking shal 1
be installed prior to Certificate of Occupancy.

B. The parking area on the east side of "C" Street shall be
tied to the office parcels on the west side by a recorded
covenant or deed restriction guaranteeing that the parking
will not be sold separate from the office complex. These
parcels utilized for parking on the east side of "C" Street
shall be tied together to eleminate lot lines.
C. The corners at "B" and "C" Streets require revision. The
curb must be enlarged to 35' and the appropriate corner
cut-off dedications to accommodate these radii.
The curb should be replaced by the developer, with required
street tree removal, or the developer should provide a
peformance bond guaranteeing installation at such time when
it is determined necessary by the City.
D. An irrevocable offer of dedication for a 10' wide strip
along the Main Street frontage shall be executed to conform
to the Master Plan of Streets and Highways.
E. In the event a portion of "C" Street is not vacated, a
pedestrian activated signal shall be provided by the
developer for the detached parking lot on the east side of
"C" Street. The developer shall either install the system
prior to Certificate of Occupancy, or provide a cash
deposit with a cost escalator agreement to the City.
F. Street improvement plans shall be submitted prior to the
issuance of building permits and construction of
improvements for:
1. The easterly side of "B" Street adjacent to the site.
2. Installation of Marbelite street lights with
underground conduit along the frontages of "B", Main
and "C" Streets adjacent to the development.
G. The payment of sewer connection fees on a portion of the
property (66' x 150') located at the most southwesterly
corner of the site is required prior to building permit
issuance.
H. Additional fire hydrants shall be provided as required by
the Orange County Fire Marshal's office. Plans for their
installation and the upgrading of the water main shall be
submitted to and approved by the Orange County Fire
Marshal, Tustin Water Works, and the City Engineer.
I. All roof top equipment shall be screened in a manner
consistent with the architecture.
J. Five (5) parking stalls for the handicapped shall be
provided with at least two (2) provided on the west side of
"C" Street.
K. Dense plant screening and a 6'8" masonry wall shall be
provided along the southerly property lines to ensure
privacy for the neighboring residential properties.
L. Trash enclosures shall be provided at the ends of the drive
aisle of the 21-stall parking area.

M. The final site plan for plan check shall show all property
lines, easements, and utility lines, proposed and existing.
N. Signing for the project shall conform to all provisions of
the Professional Districts of the Sign Code which
authorize:
1- 12 sq. ft. (single face) center identification sign for
each street frontage.
i - 6 sq. ft. wall sign per tenant
O. Any subdivision of the properties must conform to
provisions of the Subdivision Ordinance and the resultant
lot lines conform to setback and separation requirements of
the Uniform Building Code (1976).
P. The developer shall submit all improvement plans and copies
of recorded documents as required by staff, in a unified
set of plan check documents.
Q. The final layout for the off-site parking facilities shall
require the review and approval of the Community
Development Director and shall conform to the requirements
of the development standards for landscaping and parking
accommodations. Access and circulation shall require the
review and approval of the City Engineer.
R. The developer shall form an agreement with the City
regarding the acquisition of parking spaces for public use,
subject to the review of the City Attorney.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on the 1st day of June, 1981.
