HomeMy WebLinkAboutPC RES 1970 1 2 4 5 6 ? 8 9 10 11 12 15 14 15 16 18 19 20 21 22 25 24 25 26 27 28 29 50 51 RESOLUTION NO. 1970 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AUTHORIZING DEVELOPMENT OF A TWENTY (20 UNIT RESIDENTIAL PROJECT ENCOMPASSING TWO PHASES IN THE PLANNED DEVELOPMENT DISTRICT. The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application (Use Permit 81-12), was filed by Arnold F. Hamala, requesting authorization to construct twenty residential units in two phases on the easterly side of Holt Avenue, 292 feet southerly of Warren, within the Specific Plan No. 6 area. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use is in conformance with the land use element of the Tustin Area General Plan. 2. The design is in conformance with the provisions of the planned Development District. 3. The design is in substantial conformance with the development regulations of Specific Plan No. 6. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. That a Negative Declaration has been applied for to comply with the provisions of the California Environmental Quality Act, and is hereby approved. F. Proposed development shall be in accordance with the development policies adopted by-the City Council; Uniform Building Codes as administered by the Building Official; Fire Codes as administered by the Orange County Fire ~arshal; and street improvement requirements as administered by the City Engineer. G. The Planning Agency hereby authorizes the development of a twenty (20) unit residential project as applied for, subject to the following conditions: A. The final site plan shall be standardized and reflect all appropriate City stand~rd drawing numbers. The developer shall construct all missing or ~ street improvements to said development per the City of Tustin '%ti,laura Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but is not limited to: curbs and gutters, sidewalks, drive aprons, street trees and street lights. B. A Tentative and Final Map must be submitted and approved in compliance with the Subdivision Ordinance. C. The establishment of a Homeowner's Association for all the maintenance of all coaxmm areas and the submission of CC~'s to the City Attorney for review and approval. D. All utilities serving the proposed development shall be undergrounded within the exterior boundary lines of the property. E. The project sh~ll conform With the development regulations of Specific Plan No. 6, as adopted by Resolution No. 81-52. F. The CC~R's shall stipulate that garages shall be used primarily for the storage of vehicles as outlined in the Tus~in City Code Definitions 9297, s~d shall ~in permanently maintained as a parking accc~tion. G. A permit shall be required from Orange County Environmental Management Agency if any drainage is planned to flow into the adjacent flood control channel. H. Payment of all required Orange County Sanitation District fees and East Orange Water District fees shall be due. I. At such time that the Fire Department emergency access is no longer required, the area shall convert to a common recreation area. J. Individual tr~__sb receptacle pick-up shall be restricted to along the private driveway, subject to written approval frcm the disposal service. K. This development sh~ll be required to annex to the Tustin Lighting District. L. A final grading plan is required for review and approval. M. A landscape plan is required for review and approval.
