HomeMy WebLinkAboutPC RES 1952 1 2 4 5 ? 8 9 10 '11 12 13 14 15 16 17 18 19 20 21 22 2~ 24 25 26 28 29 30 31 32 RESOLUTION NO. 1952 A RESOLUTION OF THE TUSTIN PLANNING AGENCY OF THE CITY OF TUSTIN GRANTING A USE PERMIT TO EXPAND THE PETROLEUM DISTRIBUTION FACILITY AT THE SOUTEAST CORNER OF LAGUNA ROAD AND NEWPORT AVENUE iANNIN3 AGENCY OF THE CITY OF TUSTIN GRANTING A USE PERMIT TO EXPAND THE PETRO~ DISTRIBUTIfN FACILITY AT ~IE SOUTHEAST OgRNER OF LAGUNA BOAD AND NEWPfRT AVENUE The Planning Agency of the City of Tustin does hereby resolve ms follows: 1. The Planning Agency finds and determines as follows' (a) That a proper application, Use Permit No. 81-9 was filed on behalf of Southern Counties Oil Company to request authoriziation to expand building facilities at the southeast corner of Laguna Road and Newport Avenue (1011 Laguna Road) to inculde a 40' by 80' oil storage warehouse. (b) That a public hearing was duly called, noticed and held on said application; (c) That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case be detrimental to the health, safety, morals, cc~fort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) 2) The expansion will enhance the appearance of the area by removing exterior storage from public The use is in conformance wih the zoning code. (d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. (e) Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered bM the Orange Fire N~rshal, and street improvement requirements as administered by the City Engineer. (f) The project is catagorically exempt from California Environmental Quality Act. (g) Final development plans shall require the review and approval of the Ccemmnity Development Director. 2. The Planning Agency hereby grants a Use Permit, as applied for, to allow construction of a oil storage building subject to the fo1 lowing conditions. There shall be a setback of 5'0" from the alley. (c) The parking spaces which back on to Laguna shall be relocated to the enterior of the site with this area converted to planters. (d) Any missing or damaged street tmp. rov~_.nts shall be constructed or replaced. These would include curb, gutter, sidewalk, drive aprons and street trees. (e) That the existing lot lines dividing the facility shall be removed in an appropriate manner provided for in the city's Subdivision Ordinance.
