HomeMy WebLinkAboutPC RES 1949 1 2 4 5 ? 8 9 10 11 12 15 14 15 16 17 18 19 20 Zl 22 25 24 25 26 27 28 29 50 51 $2 RESOLUTION NO. 1949 A RESOLUTION OF THE TUSTIN PLANNING AGENCY GRANTING AUTHORITY TO CONSTRUCT SIX CONDOMINIUM UNITS AT 1122 SYCAMORE AVENUE The Planning Agency of the City of Tustin does hereby resolve as fol lows: I. The Planning Agency finds and determines as follows: A. That a proper application (Use Permit 81-6) was filed by Rocky Luzzi to request authorization to construct six condiminium units at 1122 Sycamore Avenue. B. That a public hearing was duly called, noticed, and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The development as proposed is in conformance with the Tustin Area General Plan. 2. The site plan as submitted is in substantial conformance with the requirements of the Planned Development District. D. The project is categorically exempt from the requirements of the California Environmental Quality Act. E. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the pro- perty, nor to the general welfare of the City of Tustin, and should be granted. F. Proposed development shall be in accordance with the develop- ment policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement requirements as administered by the City Engineer. G. Final development plans shall require the review and approval of the Community Development Director. II. The Planning Agency hereby grants a Use Permit 81-6,as applied for, to authorize the construction of six condominium units at 1122 Sycamore Avenue, subject to the following conditions. A. That the development of the subject property shall be done in conformance with ~11 applicable codes and standards, to include the City of Tustin Development Standards, the Zoning Ordinance, as amended (Ordinance #157), and the Sign Ordinance, (Ordinance #684). The establishment of an Owner's Associaton for all the maintenance of all common areas and the submission of CC&R's to the City Attorney for review and approval. D. A final grading plan shall be submitted for review and approval. E. All utilities serving the proposed development shall be undergrounded within the exterior boundary lines of the property. F. The completion of all missing or damaged street improvements, which includes, but is not limited to: curb and gutter, sidewalks, drive aprons, street trees, or any required marbelite street lights with underground conduit. G. Payment of all required Orange County sanitation district fees and east Orange County water district fees. H. That a final construction site plan and elevations shall be submitted to the Planning Agency for reviews prior to permit issuance. I. Annexation of the subject parcel to the Tustin Lighting District shall be required. Proof of said submission shall be provided to the city prior to approval of the final map. J. The proposed building elevation directly facing the adjacent R-1 single family residents shall restrict placing architectural openings on the second story. K. A 6'- 8" block wall is required along the southern boundary adjacent to R-1 single family residences.
