RESOLUTION NO. 1948
A RESOLUTION OF THE TUSTIN PLANNING AGENCY
APPROVING A USE PERMIT TO AUTHORIZE THE CONVERSION
OF AN OFFICE BUILDING TO CONDOMINIUM UNITS AT 14742
PLAZA DRIVE
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application for Use Permit 81-5 was filed by
A.C. Robertshaw on behalf of Tustin Partnership for the
conversion of an office building to separate office
condominium units at 14742 Plaza Drive.
B. That a public hearing was duly called, noticed, and held on
said application.
C. That establishment, maintenance and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
findings:
1. The use is in conformance with Tustin Area General Plan.
2. The conversion to condominium units will not change the
land use of the property.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the subject
property, nor to the general welfare of the city of Tustin,
and should be granted.
E. Proposed development shall be in accordance with the develop-
ment policies adopted by the City Council, Uniform Building
Codes as administered by the Building Official, Fire Code as
administered by the Orange County Fire Marshal, and street
improvement requirements as administered by the City
Engineer.
F. The project is categorically exempt from the requirements of
the California Environmental Quality Act.
II. The Planning Agency hereby grants a Use Permit as applied for, to
allow the conversion of the office building at 14742 Plaza Drive
to individually owned offices, subject to the following condi-
tions:
A. That tentative tract map and final tract shall be submitted
to, and approved by, the City for recordation.
B. That the formation of a "Community Association" and approval
of the community covenants, conditions, and restrictions is
required. The Association and CC&Rs shall include the
following:
1. Provide for the maintenance of common areas and the
landscaping along street frontages and parking lots.
2. The mechanisms of allocating parking for individual units
under a master parking plan.

3. That the CC&Rs will include, but not be limited to,
disclosure of management agreements, maintenance pro-
visions, access for emergency repairs, easements, etc.
so future purchasers will be aware of some problems which
might occur.
4. That the Community Association is responsible for enforc-
ing provisions of the CC&Rs, as approved by the City
Attorney.
5. That all tenants, regardless of type of professional
specialty, shall conform to the requirements of the Pro-
fessional District of the Tustin Sign Code and of the
design restrictions of a Master Sign Plan submitted by
the developer and approved by the Community Development
Director.
6. The occupancy of the units is limited to general office
uses for the second floor and the first floor may be used
for medical offices.
7. That all missing or damaged street improvements shall
be replaced as indicated by the City Engineer.
PASSED AND ADOPTED at a r~ting of the Tustin Planning Agency,
held on the 6th day of April, 1981.
