HomeMy WebLinkAboutPC RES 19451 4 5 6 ? 8 9 10 11 12 14 15 16 17 18 19 2O 21 22 25 24 25 26 27 28 29 $0 51 RESOLUTION NO. 1945 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN RECOMMENDING APPROVAL TO THE CITY COUNCIL OF TENTATIVE TRACT 11370 The Planning Agency of the City of Tustin does hereby resolve as fol lows: 1. The Planning Agency finds and determines as follows: A. That a proper application was filed by Madole and Associates on behalf of the Robert P. Warmington Company pursuant to the provisions of the sub- division Ordinance No. 651 (as amended) for the purpose of creating a two (2) lot residential condominium project for the property located at the southwesterly terminus of Newport Avenue. · B. That said Tentative Tract Map is in conformance with the Tustin Area General Plan. C. That a Negative Declaration has been applied for to conform with the California Environmental Quality Act. The Planning Agency hereby recommends to the City Council Approval of Tentative Tract 11370 subject to the following conditions: A. The map should be revised to reflect the following: The design requirements of the public street (Newport Ave.) will be under the jurisdiction of the City Engineer. However, all private street design is under the jurisdiction of the Community Development Director. B. Dedication of all street right-of-way along Newport Avenue as required by the City Engineer. C. Dedication of all access rights to Newport Avenue to the City except at driveway openings per the approved site plan. D. Annexation of entire parcel to the Tustin Lighting District. Proof of submission of subject annexation must be provided the City prior to final approval of final tract map. E. Installation of marbelite street lights With under- ground conduit along Newport Avenue as required by the City Engineer. F. Preparation of street improvement plans and con- struction of said improvement which include but are not limited to the following: a. Street Paving b. Curb and Gutter c. Domestic Water and Sanitary Sewer Facilities G. Payment of County Sanitation District No. 7 fees in the amount of $11,530.00. H. Payment of East Orange County Water District Boundary fees in the amount of $500.00 per unit. I. Preparation of a final grading plan for review and approval by the City. J. Notification to all buyers of the subject condominum units of the possibility of the extension of Newport Avenue to Edinger St. as outlined in Resolution No. 1943. K. Submission of C.C. & R.'s to the City Attorney's office for review and approval. L. Payment of Parkland dedication fees. M. That the property line between parcels 1 and 2 shall be appropriately adjusted, if necessary on the final map to allow improvement of Parcel 1 (Phase I) in conformance with the applicable zoning, fire and building codes. N. That performance bonds shall be required to cover improvement costs of work along the common lot line of parcel 1 with parcel 2, in the event Phase II is not developed.
