RESOLUTION NO. 1943
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN APPROVING USE PERMIT NO. 81-2
GRANTING AUTHORITY TO CONSTRUCT 208 RESIDENTIAL
CONDOMINIUM UNITS ON THE PROPERTY AT THE
SOUTHWESTERN TERMINUS OF NEWPORT AVENUE
The Planning Agency of the City of Tustin does hereby resolve as
follows:
1. The Planning Agency of the City of Tustin does hereby resolve
as follows:
A,
That a proper application, Use Permit No. 81'2 was filed
by the Robert P. Warmington Company to request
authorization to develop 208 residential condominiums
on the property at the southwesterly terminus of Newport
Avenue (14901 Newport Avenue).
B,
That a public hearing was duly called, noticed and held
on said application;

That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
The use is in conformance with the Land Use
Element of the Tustin Area General Plan and
zoning provisions of the Planned Development
District.

That the establishment, maintenance, and operation of
the use applied for will not be injurious or detrimental
to the property and improvements in the neighborhood of
the subject property, nor to the general welfare of the
City of Tustin, and should be granted.

Proposed development shall be in accordance with the
development policies adopted by the City Council,
Uniform Building Codes as administered by the Building
Official, Fire Code as administered by the Orange County
Fire Marshal, and street improvement requirements as
administered by the City Engineer.

That a negative declaration of environmental impacts has
been applied for.

Final development plans shall require the review and
approval of the Community Development Director.
2. The Planning Agency hereby grants a Conditional Use Permit,
as applied for, to authorize 208 residential Condominium
units, subject to the following conditions:
A. Compliance with the Subdivision Map Act by the
submission of Tentative Tract Map, the recordation

of final map and covenants, conditions, and
Restrictions for the project prior to the
issuance of building permits.
That thirty-five percent (35%) of the units shall
be provided at a price affordable to households earning
eighty percent (80%) to one hundred and twenty percent
(120%) of the median income as determined by the
Community Development Director.
Preparation of street improvement plans and
construction of said improvement which include
but are not limited to the following:
a. Street paving
b. Curb and gutter
c. Sidewalks
d. Driveway aprons
e. Street lights
f. Street trees
g. Domestic water and sanitary sewer facilities
Approval of the final garage and parking layout by the
City's contract refuse collection service.
A continuous all-weather emergency roadway with 13'6"
clearance shall be provided around the perimeter of
the project as required by the Orange County Fire
Marshal's office.
On-site fire hydrants shall be provided, as required by
the Orange County Fire Marshal.
Roofing material shall be of a fire-retardant nature.
Automatic fire sprinklers shall be provided for the
residential structures as required by the Uniform
Fire Code, as amended.
Automatic fire sprinklers and fire hose cabinets
shall be provided in the below-grade parking areas
as required by the Uniform fire code, as amended.
Ail overhead electrical and similar service wires or
cables will require conversion to underground services.
The CC&Rs shall contain: 1) notification to future
buyers of the City's Plan to either extend Newport
Avenue southerly to Edinger Street with an at-grade
crossing of the railroad tracks or with a grade separa-
tion approximately 22' above the tracks, and; 2) dedica-
tion of all right-of-way along Newport Avenue as re-
quired by City Engineer.
Construction plans for Phase I shall be designed so that
this part of the project will comply with all zoning,
building, and fire code requirements as a completed
project.
Upon development of Phase II, the common property line
dividing the two phases will be removed by a tract map.

Sound attenuation walls shall be provided to reduce
exterior noise levels from freeway and railroad sounds.
Temporary tract signs are authorized as requested and
in conformance with Article VIII Section 2A and 6 of
the Tustin Sign Code for a period of 1 year after
initial occupancy of Phase II units.
PASSED AND ADOPTED as a regular meeting of the Planning Agency of the
City of Tustin, California, held on the~m~ day of
