RESOLUTION NO. 1930
A RESOLUTION OF THE PLANNNING AGENCY OF THE
CITY OF TUSTIN, GRANTING AUTHORITY TO CONVERT
THE APARTMENT COMPLEX AT 1651 MITCHELL AVENUE
TO SEVENTY (70) RESIDENTIAL CONDOMINIUM UNITS,
AS REQUESTED IN USE PERMIT APPLICATION 80-21·
The Planning Agency of the City of Tustin does hereby resolve as fol-
lows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (Use Permit 80-21) was filed on be-
half of Windsor Partner Ltd., by Frederick J. King to rquest
authorization to convert the Windsor Garden Apartments to
seventy (70) residence condominium units at 165~ Mitchell
Avenue.
B. That a public hearing was duly called, noticed, and held on
said application.
C. That establishment, maintenance and operation of the use ap-
plied for will not, under the circumstances 'of this case, be
detrimental to the health, safety, morals, comfort or general
welfare of the persons residing or working in the neighbor-
hood of such proposed use, evidenced by the following find-
ings:

The use is in conformance with the Tustin Area General
Plan.

The development is in conformance with the Planned De-
velopment (PD) District standards.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the prop-
erty and improvements in the neighborhood of the subject pro-
perty, nor to the general welfare of the city of Tustin, and
should be granted.
E. Proposed development shall be in accordance with the develop-
ment policies adopted by the City Council; Uniform Building
Codes as administered by the Building Official; Fire Code as
administered by the Orange County Fire Marshal; and street
improvement requirements as administered by the City
Engineer.
F. Final development plans shall require the review and approval
of the Community Development Director.
G. That this project is categorically exempt from the require-
ments of the California Environmental Quality Act.
II. The Planning Agency hereby approves Use Permit No. 80-21, as ap-
plied for, to authorize the conversion of the Windsor Garden
Apartments to seventy (70) residential condominiums, subject to
the following:
A. The developer shall comply with the Subdivision Ordinance and
file tentative and final tract maps.
B. Submission of CC&Rs for review and approval by the city at-
torney's office.
C. That the formation of a "Community Association" and approval
of the community covenants, conditions, and restrictions is
required. The Association and CC&Rs shall include the
following:
1. Provide for the maintenance of common areas and landscap-
ing along street frontages.

2. Numbered parking spaces shall be allocated for each ten-
ant.

That the CC&Rs will include, but not be limited to, dis-
closure of management agreements, maintenance provisions,
access for emergency repairs, easements, etc. so future
purchasers will be aware of some problems which might
Occur.
4. That the Community Association is responsible for enforc-
ing provisions of the CC&Rs, as approved by the city
attorney.
D. Dedication of easements for all required utilities to each
air space subdivision.
E. Annexation of entire parcel to the Tustin Lighting District.
Proof of submittal of said annexation to the County
Surveyor's office must be furnished to the City prior to ap-
proval of the final tract map.
F. Installation of Marbelite street lights with underground con-
duit along the Mitchell Avenue frontage of the subject de-
velopment.
G. Installation of street trees along the Mitchell Avenue front-
age of the subject development per the City's master plan of
trees.
H. Construction/replacement of all new, missing or damaged pub-
lic street improvements per City standards.
I. A detailed grading plan, showing the disposition of all
drainage, shall be submitted for review and approval.
J. Installation of all utilities underground in connection with
this development with no poles .being set either on or ad-
jacent to the subject development.
K. Ail street lights, fire hydrants, and catch basins shall be
plotted on the final site plan to determine if any conflicts
exist with proposed drive locations.
L. The walls adjacent to the driveway ramp shall be no higher
than 36" for a distance of 20 feet behind street right-
of-way.
M. Precise plans for the construction of the underground parking
area and ramps shall be submitted by a certified structural
engineer.
N. Planting and irrigation plans shall be submitted for those
areas to be modified as a result of construction.
O. Patio covers may be authorized at a maximum of 120 square
feet per unit with approval of the Homeowner's Association
and permit issuance by the City Building Division.

P. Provide fire hose cabinets on 150' centers with 75' of 1 1/2"
fire hose with spray nozzles attached in garage area, plus a
2A iOBC fire extinguisher in a tamper-proof case with hose.
Q. Provide a minimum 13'6" of clearance in the undergrund
parking area with a turn-around area as shown in Exhibit "A".
R. Fire hydrants shall be added as directed by the Orange County
Fire Marshal's office.
S. The proposal shall conform with all requirements of Ordinance
No. 822, Apartment Conversion Standards.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of the
City of Tustin, held on the 17th day of November, 1980.
