RESOLUTION NO. 1921
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN GRANTING A CONDITIONAL USE PERMIT FOR
THE CONSTRUCTION OF A NINE (9) UNIT RESIDENTIAL
CONDOminium AT 1370 SAN JUAN STREET.
The Planning Agency of the City of Tusfin does hereby re~..ive as follows:
I. The Planning Agency finds and determines as follows: ~'~
A. That a proper application (Use Per, if 80-19} was filed by M. Pefyo
and Associates, Inc., on behalf of R~berf White, requesting
authorization fo construct a nine (9) unit residential condominium
development, subject to the Planning Developmen, (PD) District
standards af 1370 San Juan Street.
B. That a public hearing was duly called, noticed and held on
said application.
C. That establishment, maintenance and opera, ion of the use applied
for will not, under the circumstances of this case, be de,ri-
mental to the health, safety, morals, comfort, or general welfare
of the persons residing or working in fha neighborhood of such
proposed use, evidenced by the following findings:
The use is in conformance with the Land Use Element of fha Tusfin
Area General Plan and in substantial conformance with fha Planned
59velopmenf District standards of the Tusfin Zoning Code.
D. That the establishment, maintenance and opera, ion of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor fo the general welfare of the city of Tustin, and should
be granted.
E. Proposed development shall be in accordance with the develop-
ment policies adopted by the City Council, Uniform Building Codes
as administered by the Building Official, Fire Code as administered
by fha Orange County Fire Marshal, and street imorovement re-
quirements as administered by the City Engineer.
F. That the project is categorically exempt under Class 15, CEQA
provisions.
G. Final development plans shall require the review and approval of
the Community Development Director.
II. The Planning Agency hereby grants a conditional use permit, as applied
for, fo authorize fha construction of a nine (9) unit residential
condominium af 1370 San Juan Street, subject to the following con-
difions:

A. A final grading plan will be required to be submitted for the
subject development.
B. The final site plan shall shoe,- all utilities and :_;bsfrucfions
within the public right-of-way related to the subject development.
C. The drive approach as shown shall extend beyond ,he right-of-way
line. The approach within the public right-of-way shall ex,end
from the back of curb fo the right-af'-wey line.

D. Ali street improvements shall be shown on a plan and profile
drawing, with design considerations based upon future and/or
existing curb and gutter grades on the southerly side of San
Juan Street.
E. The proposed sanitary sewer and water laterals shall be shown on
the final site plan.
F. The building shall be provided with an approved automatic fire
Sprinkler system.
G. Planting and irrigation plans shall be submitted with the build-
ing, electrical, and plumbing plans for review and approval.
H. Compliance with the Subdivision Map Act by the submission o¢
Tentative Tract Map, the recordation of a Final Map and of
Covenants, Conditions, and Restrictions for the project prior
fo the issuance of building permits.
I. All overhead electrical and similar service wires or cables will
require conversion fo underground services.
J. Construction plans shall contain evidence prepared by a Sound
Engineer of compliance with Title 25, Noise Insulation Standards.
K. The building shall be set back from the front property line at
least 15' with guest parking provided on each side of the drive-
way in a landscaped area designed to support vehicles.
