RESOLUTI ON NO. 1918
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A VARIANCE ON APPLICATION
NO. V 80-16 AT 2152 SWEETBRIAR ROAD.
The Planning Agency of the City of Tusfin does hereby resolve as follows:
!. The Planning Agency finds and determines as follows:
A. That a proper application for variance No. 80-16 was filed
on behalf of Michael Gyure for a variance to permit construction
of a spa within fha 5 foot sideyard setback area on the pFoperty
located at 2152 Sweetbriar Road.
B. That a public hearing was duly called, noticed and held on
said application.
C. That because of special circumstances applicable fo the subject
property, relative to size, shape, topography, location or sur-
roundings, a strict application of the zoning ordinance is found
fo deprive the sub]ecl property of privileges enjoyed by other
properties in fha vicinity and under identical zone calssific-
cation, evidenced by the following finding:
Due fo the restrictive size and shape of the recreational side
yards.
D. That the granting of a variance as herein provided will not
constitute a grant of special privilege inconsistent with fha
limitations upon other properties in the vicinity and district
in which the subject property is situated.
E. That the granting of the variance as herein provided will not be"'
contrary to the intent of the zoning ordinance or the public
safety, health and welfare, and said variance should be granted.
F. Proposed development shall be in accordance with the develooment
policies adopted by the City Council; Uniform Building Codes as
administered by the Building Official; Fire Code as administered
by fha Orange County Fire Marshal; and street improvement require-
ments as administered by the City Engineer.
G. That this project is categorically exempt from the requirements
of the California Environmental Quality Act.
II. The Planning Agency hereby grants a variance as applied for, to.per-
mit construction of a spa within the 5 foot sideyard setback area,
subject fo the following conditions:
A. All plans submitted for construction of pool (or spa) shall show
precise propert~ lines.
B. All accessory parts and equipment for pool (or spa) shall be no
closer than 3" from the property line.
