RESOLUTION NO. 1914
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, SETTING FORTH FINDINGS THAT
AN EMPLOYEE RECREATIONAL-CAFETERIA FACILITY
WITHIN INDUSTRIAL OR OFFICE COMPLEXES NOT BE
REQUIRED TO HAVE PARKING IN EXCESS OF THOSE
PROVIDED FOR THE PRIMARY USE.
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That Section 5.2 of Ordinance 157 (Zoning Ordinance) provides
fhaf if any ambiguity arises concerning the appropriate classi-
fication of a particular use within the meaning and intent of
this Chapter, with respect to matters of height, area require-
ments or zone boundaries as set forth herein, the Planning
Agency shall ascertain all pertinent facts and by resolution
set forth ifs findings and interpretations and thereafter such
interpretations shall govern, except if fha City Council of
Tusfin directs the Planning Agency fo adopt a different infer-
prefation.
B. That the Planning Agency, at their meetin9 of September 2, 198:0
did ascertain all pertinent facts relating to the appropriate
parking regulations for such uses.
C. That recreational and cafeteria facilities for the sole use
of tenants and employees are authorized in conjunction with
an office or industrial use.
D. That employee recreational or cafeteria facilities do not in-
crease the' parking demands above that required for the primary
uses.

!1. The Planning Agency, therefore, finds that no additional parking
spaces will be required for the floor area of employee recreational
or cafeteria facilities in addition fo those spaces provided for
the office and industrial floor areas (gross) sub.ject to the follow--
ing condi t ions:
A Use is authorized only for tenants .and employees working at
the site of the recreational or cafeteria facility.
B. The recreational or cafeteria use shall be and remain clearly
ancillary fo the primary use of the site.
C. Any changes in the use of such facility or in the operation
from solely tenant/employee use will require parking fo be
provided for the floor space equal fo what is required for
the primary use of the site.
D. Deed restrictions, recorded covenants, or other appropriate
legal documentation to ensure compliance by present and future
owners with these conditions shall be submitted fo the city
attorney for review and approval.
E. That the areas fo be used for such purposes shall be specifically
