RESOLUTI ON NO. 1912
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING AUTHORITY TO VARY
WITH THE OPEN SPACE REQUIREMENTS OF THE
PLANNED DEVELOPMENT DISTRICT AND PERMITTING
THE CONSTRUCTION OF 36 CONDOMINIUM UNITS AT
15520 THROUGH 15582 SOUTH "B" STREET.
The Planning Agency of the City of Tusfin does hereby resolve as follows:
I. The Planning Agency findS and determines as follows:
A. That a proper application (Variance No. 8014) was filed on
behalf of Beyer and Warden, Inc., fo request authorization fo
vary with the open space requirements of the Planned Development
(PD) District to construct 36 residential condominium units at
15520 through. 15582 South "B" Street.
B. That a public hearing was duly called, noticed and held on said
application.
C. That because of special circumstances applicable fo the subject
property, relative to size, shape, topography, location or sur-
roundingst a strict application of the Zoning Ordinance is found
fo deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classific-
cation, evidenced by the following findings:
1. The use is in conformance with the land use element of the
Tustin Area General Plan.
2. The site configuaration, which was subdivided under county
jurisdiction, presents a hardship to design within Planned
Development standards. .
D. That the granting of a variance as herein provided will not con-
sfitute a grant of special privilege inconsistent with the limi-
tations upon other properties in the vicinity and district in
which the subject property is situated.
E. That this project is categorically exempt from the requirements
of the Calfornia Environmental Qualify Act.
F. That the granting of the variance as herein provided will not be
contrary to the intent of the Zoning Ordinance or the public
safetyt health and welfare, and said variance should be granted.
G. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Orange County Fire Marshal, and street improvement re-
quirements as administered by the City Engineer.
H. Final development plans shall require the review and approval of
the Corrrnunify Development D. irecfor.
!i. The Planning Agency hereby grants a variance as applied fort fo
authorize construction of a 3d-unit condominium project with 45%
open spacer subject fo the following conditions:
A. Compliance With t'he Subdivision Map Act by the submission of
Tentative Tract Map, the recordation of a Final Map and of
covenants, conditions, and restrictions for the project prior
fo the issuance of building permits.

B. The developer shall be required fo have a Civil Engineer pre-
pare improvement plans for "B" Street and should be required to
construct all missing or damaged street improvements adjacent
fo said development per the City of Tustin "Minimum Design
Standards for Public Works" and "Street Improvement Standards."
C. The developer shall provide a sanitary sewer in "8" Street to
service the property.
The developer will be required to pay sewer connection fees to
the Orange County Sanitation District, per their Ordinance.
D. The developer shall provide a domestic water line in "B" Street
fo service the property.
E. Re-dedication of the public right-of-way and additional dedi-
cations for public right-of-way shall be required.
F. Street trees shall be provided along "B'" Street at 40 Feet on
center.
G. The interior drive aisle shall be a minimum of 27' wide.
H. A sound attenuation wall, designed by an acoustical engineer
shall be provided aion9 the Santa Ana Freeway Frontage to reduce
the on-site noise level at the first floor height, to 65 db(A).
!. A final grading plan shall be required for review and approval.
J, Planting and irrigation plans shall be submitted with building
plans for review and approval.
K. Fire defection system shall be provided and installed in accord-
ance with UBC Section 13!0. The defectors shall be State Fire
Marshal approved.
L. One on-site fire hydrant and one public fire hydrant on "B"
Street shall be provided in conjunction with this development.
That the roof covering shall be of a non-combustible material
for increased fire protection.
PASSED AND ADOPTED afa regular meeting of the Tusfin Planning Agency,
held on the 18th day of August, 1980.
