RESOLUTION NO. 1907
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A USE PERMIT TO AUTHORIZE
THE CONSTRUCTION OF A PROFESSIONAL OFFICE CONDO-
MINIUM AT 730 EL CAMINO WAY.
The Planning Agency of the City of Tusfin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application, Use Permit 8-16, was filed on behalf
of Mr. Mark Kornwasser by Daniel Dworsky, FAIA Architect and
Associates for authorization to construct a professional office
condominium on the northwesterly corner of El Camino and
the Santa Ana Freeway on-ramp.
B. That a public hearing was duly called, noticed, and held on
said application.
C. That establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detri-
mental fo the health, safety, morals, comfort or general wet-
fare of the persons residing or working in the neighborhood of
such proposed use, evidenced by the following findings:
1. This is in conformance with the Land Use Element of the
Tusfin Area General Plan.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental fo the property
and improvements in the neighborhood of the subject property,
nor fo the general welfare of the City of Tusfin, and should be
granted.
E. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Orange County Fire Marshal, and street im-
provements as administered by the City Engineer".
F. An initial environmental study has been submi[ted to request
a negative declaration.
G. Final development plans shall require the review and approval
of the Community Development Department.
II. The Planning Agency hereby grants a use permit as applied for, fo
authorize construction of a 17,180 square foot, three-story office
condominium with 64 on-site parking spaces af 730 E! CaminoWay,
subject fo the following conditions:
A. The developer shall comply with the Subdivision Ordinance and
file tentative and final tract maps.
B. Developer sh~ll be required fo make a payment of $50 per free
to the City for planting of street trees af 40' on center for
El Camino Way.
C. All public improvements to be constructed in conjunction with
this development shall be completed prior fo the issuance of
any Certificate of Occupancy. Improvements shall include, but
not be limited to, the following:
1. Curb and gutter
2. Sidewalk
3. Drive apron
4. Street pavement
5. Street trees
6. Street lights

D. A detailed grading plan, showing the disposition of all drainage,
shall be submitted for review and approval.
E ·
Installation of all utilities underground in connection with
this development with no poles being set either on or adjacent
to the subject development.
F. All street lights, fire hydrants, and catch basins shall be
plotted on the final site plan fo determine if any conflicts
exist with proposed drive locations.
G. That the formation of a "Community Association" and approval of
the community covenants, conditions, and restrictions is re-
quired. The Association and CC&Rs shall include the following:
1. Provide for the maintenance of common areas and the land-
scaping along street frontages.
2. Provide for the maintenance service and payment of charges
for the fire defection and sprinkler systems fo include
expansion of service upon improvements or alterations of
tenant units, if if is determined by the Orange County
Fire Marshal's office that such systems are required·
3. Numbered parking spaces shall be allocated for each tenant
space, based upon square footage requirements of the Tusfin
Zonin9 Code.
4. That the CC&Rs will include, but not be limited fo, dis-
closure of management agreements, maintenance provisions,
access for emergency repairs, easements, etc. so future
purchasers will be aware of some problems which might occur.
5. That the Community Association is responsible for enforcing
provisions of the CC&Rs, as approved by the city attorney.
6. That ali tenants, regardless of type of professional
specialty, shall conform fo the requirements of the Pro-
fessional District of the Tusfin Sign Code and of the
design restrictions of a Master Sign Plan submitted by the
developer and approved by the Community Development Director.
H. That a perpetual easement be provided for all utilities isewer,
wafer, telephone, gas, electricity, heating, and air conditioning,
etc.)
I. The location and construction plans of the fuel pump must be
approved by the Orange County Fire Marshal's office. IF its
installation is not feasible under existing codes and regulations,
the area shall be used for parking.
J. The CC&Rs shall prohibit use of the fuel pump by people other than
condominium owners, their tenants and employees. Sale of fuel
from the on-site pump to the general public shall be a violation
of this use permit.
K. A main water line extension shall be provided for Fire fighting
purposes from El Camino Way and El Camino Real. The precise
size and water flow requirements shall be established by the
Orange County Fire Marshal's office.
