RESOLUTION NO. 1906
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN, GRANTING AUTHORITY TO VARY WiTH PROVISIONS
OF THE ZONING CODE TO EXPAND A NON-CONFORMING
SINGLE FAMILY RESIDENTIAL STRUCTURE ON A C-1 ZONED
PARCEL.
The Planning Agency of the City of Tusfin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application for a variance (No. 80-12) was filed by
Eugene F. and Rifa C. Turf to request authorization to vary with
provisions of the zoning code for expansion of a non-conforming
single familY residential structure on a commercial lot located
on Parcel No. 2 of Parcel Map filed in Book No. 25, page No. 29
of Parcel Maps of Orange County.
B. That a public hearing was duly called, noticed, and held on said
application.
C. That because of special circumstances applicable fo the subject
property, relative fo size, shape, topography, location or sur-
roundings, a strict application of the zoning ordinance is Found
fo deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classification,
evidenced by the following findings:
1. The triangular shape of the lot and proximity fo the freeway
creates a hardship of buildable area and desirability for de-
velopment.
2. The existing use is of a legal non-conforming status.
D. That the granting of a variance as herein provided will not con-
stifufe a grant of special privilege inconsistent with the ..... .
limitations upon other properties in the vicinity and district in
which the subject property is situated.
E. That the granting of the variance as herein provided will not be
contrary fo the' intent of the zoning ordinance or the public
safety, health and welfare~ and said variance should be granted.
F. Proposed development shall be in accordance with the development
policies adopted by the City Planning Agency, Uniform Building
Codes as administered by the Building Official, Fire Code as
administered by the Orange County Fire Marshal, and street im-
provement requirements as administered by the City Engineer.
G. Final development plans shall require the review and approval
of the Community Development Director.
I!. The Planning Agency hereby grants a variance as applied for, fo per-
mit expansion of an existing non-conforming single family structure,
subject to the following conditions:

A. Clearance o¢ the public right-of-way between the edge of the
pavement and the right-oF-way line (8 ft.) of all vegetation,
across the Cronfage oF the Tuff property Iresidence and nursery
sites) to provide improved visibility fo motorists.
Reduction of the front wall to three feet (3') in height where
necessary for traCfic visibility.
PASSED AND ADOPTED at a regular meeting of the Tusfin Plannin9 Agency,
held on the 21st day of July, 1980.
