The Invocation was given by A1 Enderle. The Pledge of Allegiance was led by Councilmember Worley. ROLLCALL Council Present: Jeffery M. Thomas, Mayor Thomas R. Development Martin Pastucha, Field Services Manager Valerie Crabill, Chief Deputy City Clerk Dave Gottlieb, Senior Project Manager Gary Magill, Recreation Superintendent Approximately 35 in the audience PRESENTATION ORANGE COUNTY FIRE AUTHORITY CERTIFICATES OF COMMENDATION, MARK BURKHARDT AND ELENA ROSS Battalion Chief Cleveland presented Orange County Fire Authority Certificates of Commendation to Mark Burkhardt and Elena Ross for life saving assistance administered to a co-worker; explained that the Orange County Fire Authority established the Certificate of Commendation to recognize individuals who assisted the Fire Authority or a member of the community during an emergency; encouraged the public to learn CPR; noted the Fire Authority offered free CPR classes; and stated CPR instruction had been provided to over 500 Orange County residents last year. Mark Burkhardt accepted the Certificate of Commendation on behalf of a deceased friend. Motionlcarried 4-0, Potts absent. 1. APPROVAL OF MINUTES - MARCH 2, 1998 REGULAR MEETING Recommendation: Approve the City Council Minutes of March 2, 1998. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $840,364.56 and ratify Payroll in the amount of $350,290.83. 380-10 360-82 3. RESOLUTION NO. 98-23 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15474 CITY COUNCIL MINUTES Page 2, 3-16-98 Recommendation: Adopt Resolution No. 98-23 approving Final Tract Map No. 15474 as recommended by the Community Development Department. 600-70 4. RESOLUTION NO. 98-22 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15420 LOCATED ON LOT 4 OF TRACT 12870, NORTH OF TOWNSHIP DRIVE OPPOSITE OF CLEARY COURT Recommendation: Adopt Resolution No. 98-22 approving Final Tract Map 15420 as recommended by the Community Development Department. 600-70 5. TUSTIN COMMUNITY FOUNDATION UPDATE Recommendation: Receive and file subject report as recommended by Parks and Recreation Services. 125-45 6. CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES Recommendat ion: Approve an amendment to the agreement between Accurate Landscape & Maintenance and the City of Tustin for landscape maintenance services; contract amendment would extend the agreement from July 1, 1997 to July 3 0, 1998; add the landscape maintenance of additional public right -of -ways; and grant the contractor an 8% increase in the monthly base price of the contract effective February 1, 1998 as recommended by the Public Works Department ~Field Services Division. 400-45 7. TUSTIN COMMUNITY GARDEN PROPOSAL - CINDY MCNATT Recommendation: Recemve and file; direct Agency staff to continue to meet with Ms. McNatt, the Tustin Old Town Association and other interested citizen groups, to provide assistance in determining the level of community support and participation for a community garden in Old Town Tustin; and staff will provide updates of progress to the Agency as recommended by the Redevelopment staff. 125-25 8. PLANNING COMMISSION ACTION AGENDA - MARCH 9, 1998 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of March 9, 1998. 120-50 9. RESOLUTION NO. 98-20 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN REPLACEMENT ON LEMONA LANE, SOUTHERLY OF LA COLINA DRIVE; WINDSOR PLACE BETWEEN VANDERLIP AND 17TH STREET; CAMERON LANE SOUTHERLY OF VANDERLIP AVENUE; EHLEN WAY, BRENAN WAY, HARP COURT, AND MANNING DRIVE NORTHERLY OF WARREN AVENUE; AND FAIRMOUNT WAY, SOUTHERLY OF FAIRHAVEN AVENUE (CITY PROJECT NO. 600137), AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 98-20 approving plans and specifications andlauthorizing advertisement for bids for subject project as recommended by the Public Works Department/Water Services Division. 400-45 10. RESOLUTION NO. 98-21 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING THE PREPARATION OF AN ENGINEER ' S REPORT FOR THE LEVY OF ANNUAL ASSESSMENTS FOR THE 1998 - 99 FISCAL YEAR FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT Recommendat ion: Adopt Resolut ion No. 98 - 21 ordering the preparation of an Engineer ' s Report for the levy of annual assessments for the 1998-99 fiscal year for the Tustin Landscape and Lighting District as recommended by the Public Works Department/Engineering Divi s ion. 340-60 11. UTILITY FEASIBILITY STUDY FOR MCAS TUSTIN Recommendation: Receive and file subject report as recommended by the Redevelopment Agency staff. 150-50 12. RESOLUTION NO. 98-19 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, OPPOSING THE "GOVERNMENT COST SAVINGS AND TAXPAYER PROTECTION AMENDMENT" INITIATIVE Recommendation: Adopt Resolution No. 98 - 19 opposing the "Government Cost Savings and Taxpayer Protection Amendment" initiative and direct the City Manager to convey the City ' s position to the League of California Cities as recommended by the Public Works Department/Engineering Division. 150-30 14. DENIAL OF CLAIM NO. 97 -47, CLAIMANT: BORIS SALAZAR Recommendation: Deny subject claim and direct the City Clerk to send notice to the claimant and the claimant ' s attorney as recommended by the City Attorney. 180-10 15. (Removed From Agenda) REGULAR BUSINESS (ITEMS 17 THROUGH 21) 17. ORDINANCE NO. 1197, SiGN CODE AND NOISE ORDINANCE AMENDMENTS It was moved by worley, seconded by Doyle, to have second reading by title only of Ordinance No. 1197. Motion carried 4-0, Potts absent. Following second reading by title only of Ordinance No. 1197 by the City Clerk, it was moved by worley, seconded by Doyle to adopt the following Ordinance No. 1197: ORDINANCE NO. 1197 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO TUSTIN CITY CODE SECTION 9403c TO LIMIT USE OF THE MAIN STREET BANNER POLES TO CITY SPONSORED EVENTS, AND SECTIONS 4616 AND 4617 TO PROHIBIT CONSTRUCTION ACTIVITIES ON CITY OBSERVED FEDERAL HOLIDAYS Motion carried 4-0, Potts absent (roll call vote). 230-65 680-40 18. GRAD NIGHT FUNDING REQUEST - FOOTHILL AND TUSTIN HIGH SCHOOLS It was moved by Thomas, seconded by Saltarelli, to appropriate $3,000 to Foothill High School and $3,000 to Tustin High School for Grad Night. Motion carried 4-0, Potts absent. 330-20 19. REQUEST FOR AN OFFICIAL CITY BIRD Rita Westfield, Assistant Director of Community Development, reported that the Tustin Pride Committee was requesting designation of the Hooded Oriole as the official City bird. It was moved by Worley, seconded by Saltarelli, to designate the Hooded Oriole as the official City bird. Motion carried 4-0, Potts absent. 160-30 20. CHANGING DATE OF CITY COUNCIL MEETINGS FROM MONDAYS TO TUESDAYS Mayor Thomas stated that because of Monday scheduling conflicts such as holidays and televised Monday Night Football and basketball games, citizens had requested changing I the Council meetings from Monday to Tuesday night. Councilmember Worley not'ed concern that changing the meeting days would impact the Tustin News print deadline. George Stewart, Tustin News reporter, explained that if Council meetings were moved to Tuesday, meeting coverage would not be included in the newspaper until the following week due to CITY COUNCIL MINUTES Page 4, 3-16-98 printing deadlines. Council/Speaker Stewart discussion followed regarding the Tustin News deadline and Orange County cities conducting Council meetings on Tuesdays. Councilmember Doyle stated he was opposed to changing meeting days because of Monday Night Football and he noted there were only three holidays falling on Council meeting days. Mayor Pro Tem Saltarelli said he did not have a preference on meeting' days; noted the lack of conflicts with other public agencies conducting public meetings on Tuesdays; and suggested maintaining Monday Council meetings since Councilmember Doyle had voiced displeasure in moving meeting days to Tuesdays. Councilmember Worley noted the Tustin Pride Committee met on the third Tuesday of each month; stated concern that the Tustin News would be unable to report on Tuesday meetings until the following week; and said she did not have a meeting day preference. The following member of the audience spoke in favor of Monday Council meetings: Berklee Maughan, Tustin Council concurred to retain Monday Council meetings. 420.-05 21. RECONSIDERATION TO AUTHORIZE THE TEMPORARY INSTALLATION OF DIAGONAL PARKING IN A SECTION OF EL CAMINO REAL IN OLD TOWN Dave Gottlieb, Senior Project Manager, reported that at the October 20, 1997 meeting, Council directed staff to obtain additional information from the Old Town business community regarding installation of diagonal parking on a temporary test basis; a survey of 42 business owners along E1 Camino Real was conducted by the Old Town Association; 68% of the business owners were in favor of the diagonal parking concept, 7% were opposed, 5% had no opinion, and 20% did not respond; the proposed diagonal parking on E1 Camino would total 62 spaces of which 10 were parallel parking; the proposed parking would increase the existing parking by 8 spaces; a survey conducted by the Old Town Association indicated favorable responses to the proposed diagonal parking by people attending the Tree Lighting Ceremony; a community meeting with Old Town business owners revealed the majority were in favor of diagonal parking; and proposed diagonal parking would be installed on a temporary test basis. The following members of the audience spoke in favor of authorizing installation of diagonal parking on E1 Camino Real: William Stanford, 190 E1 Camino Real, Tustin Rick Boufford, Black Sheep Bistro owner Guy Stivers, 150 E1 Camino Real, Tustin Greg Kelly, Old Town Association The following members of the audience spoke in opposition to authorizing installation of diagonal parking on E1 Camino Real: Ralph Sanchez, Rafi's Cuban Caf~ owner Arnold Surfas, Surface Limited Furtiers The following member of the audience spoke regarding surveying the existing Old Town customers on the diagonal parking: Berklee Maughan, Tustin Council/staff discussion followed regarding OCTA Technical Advisory Committee costs; E1 Camino Real was considered a Major Arterial Highway; and removing the Major Arterial Highway designation would be necessary if diagonal parking became permanent. Councilmember Worley stated that because of the favorable CITY COUNCIL MINUTES Page 5, 3-16-98 response by Old Town business owners to the temporary installation of the diagonal parking, she would support the project; commented on the success of California cities that had installed diagonal parking in their downtown areas; and diagonal parking was the beginning of area development and attracting more people to Old Town. Councilmember Doyle said he would support the temporary parking installation and was hopeful that diagonal parking would have a positive impact on downtown business. Mayor Pro Tem Saltarelli stated that diagonal parking contributed to a small town image; the downtown merchants had supported installation of the proposed parking; he supported the project; the convenience of parking in diagonal spaces; diagonal parking was a positive step for the area; and downtown lighting should be examined as soon as possible. Mayor Thomas stated that diagonal parking must be installed on a temporary basis in consideration of the businesses opposed to the proposed parking; the need for more development in Old Town; the importance of the Old Town Business Association's input on necessary changes and improvements to downtown; supported downtown lighting; if the diagonal parking was unsuccessful it must be removed; the 6-month trial basis should not negatively impact downtown businesses; and researching ways to attract additional businesses to Old Town. It was moved by Saltarelli, seconded by Worley to authorize Old Town diagonal parking on a test basis. Motion carried 4-0, Potts absent. 770-90 PUBLIC INPUT - None OTHER BUSINESS COMMENDATION - POLICE DEPARTMENT Councilmember Doyle commended the Police Department for immediate reponses to incidents at his business and neighborhood. STATUS - FIRST STREET/PROSPECT AVENUE PROPERTY Councilmember Doyle questioned the status of the property with plastic sheeting on the ground at First Street and Prospect Avenue. William Huston, City Manager, responded that the property was being cleared. MODULAR HOUSING - REDEVELOPMENT AREA Councilmember Doyle requested the Redevelopment Agency explore modular housing in which a home could be placed on a vacant lot within 21 days'. CALIFORNIA PARK AND RECREATION SOCIETY 1997 AWARD OF EXCELLENCE Councilmember Worley announced that the City had received the California Park and Recreation Society 1997 Award of Excellence for facility design of the Tustin Family and Youth Center. CEDAR GROVE PARK SWINGS Councilmember Worley reported that she had requested staff place two additional swings for a total of four at Cedar Grove Park. HOODED ORIOLE Mayor Pro Tem Saltarelli expressed pleasure with the selection of the Hooded Oriole as the official City bird. CITY COUNCIL MINUTES Page 6, 3-16-98 VOLUNTEER CONNECTION DAY Mayor Thomas reported that all Orange County cities would be participants in Volunteer Connection Day on April 25, 1998, and recommended interested residents contact staff or Tustin Pride Committee members. POW/MIA FLAG - CITY HALL Mayor Thomas requested agendizing at the April 6, 1998 Council meeting, discussion of flying a POW/MIA flag at City Hall. COMMITTEE REPORTS - None CLOSED SESSION Mayor Thomas announced the City Council would convene in closed session to confer with the City Attorney regarding pending litigation to which the City was a party: Gloria McMackin vs. City of Tustin, OCSC No. 780003; and James Peery vs. City of Tustin, WCAB Case No. AHM 005081 ADJOURNMENT Mayor Thomas adjourned the meeting at 8:13 p.m. The City Council scheduled a Capital Improvement Project Planning Workshop on April 6, 1998, 5:30 p.m., in the Community Center, and the next regular meeting of the City Council was scheduled for April 6, 1998, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
