RESOLUTION NO. 1895
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN RECOMMENDING
TO THE CITY COUNCIL DISPOSITION OF A PORTION OF ALLEY RIGHT-OF-WAY
BETWEEN EL CAMINO REAL AND "C" STREET AND NORTHERLY OF SECOND STREET
The Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency finds and determines as follows:
a.
That a proper application was filed by the
Planning Agency for the purpose of determining the
needs, if any, of public right-of-way known as a
portion of an alley between E1 Camino Real and
"C" Street and northerly of Second Street as des-
cribed by Exhibit "A," attached hereto and incor-
porated herein by this reference as set forth herein
in ful 1.

That the subject property should be declared excess
to the City's needs and disposed of for private deve-
lopment for the following reasons:
(1) The alignment and configuration of the alley
has been es tablished wi th the approved site
plan for the development at 150,160 E1 Camino
Real.
(2) The property is not suitable nor adequate for
other public purposes, such as parks or recrea-
tional needs.
(3) There is no known use of the property as alley
right-of-way.
C.
That pursuant to Section 8330 of the Streets and
Highways Code for the State of Californi.a, it is
possible to reserve public interest in easements
for sewers, storm drains, and utility purposes.

That the Agency' recommends the vacation of the ease-
ment for alley purposes to the adjoining property
owners without fee.

Subject project is exempt from an Environmental Impact
Report on the basis that this proposed action is cate-
..
gorical ly exempt.

That the vacation of the subject alley right-of-way
will be in conformance with the City of Tustin General
Plan. ,

The Planning Agency, pursuant to Sections 37350 and 65402
of the Government Code, hereby recommends to the City Council
the declaration of the subject parcel as excess to the needs
of the City and its disposition to the adjoining property
owners with the reservation of easements to conduct, maintain,
operate, replace, remove and renew those facilities necessary
for storm drains, sewers, and public utilities.

Those portions of Lots 4,5,16 and 17, Block 4, of the Tustin City
Tract as shown on a map recorded in Book 4, page 218, miscellaneous
records, of Los Angeles County , California, described as follows-
The westerly lO.O0 feet of Lots 4 and 5, Block 4,
of said Tustin City Tract and the easterly lO.O0
feet of Lots 16 and 17, Block 4, of said Tustin
City Tract.
