RESOLUTION NO. 1893
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN GRANTING A CONDITIONAL USE PERMIT
ON APPLICATION NO. UP 80-11 FOR COPES
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follow~
a. That a proper application No. UP 80-11 was
filed on behalf of COPES (Child or Parental
Emergency Services) to allow a respite home
for 5 or fewer children, 5 years of age or
younger for short term relief of stressed
parents for the property at 660 West Third
Street~
b. That a public hearing was duly called, noticed
and held on said application;
c. That this project is categorically exempt from
the requirements of the California Environ-
mental Quality Act.
d. That establishment, maintenance and operation
of the use applied for will not, under the
circumstances of this case, be detrimental
to the health, safety, morals, comfort or general
welfare of the persons residing or working in the
neighborhood of such proposed use and should
be granted.
e. Proposed development shall be in accordance wit~.
the development policies adopted by the City
Council, Unifrom Building Codes as administered
by the Building Official, Fire Code as adminis-
tered by the Orange County Fire Marshal, and
street improvement requirements as administered
by the City Engineer.
f. Final development plans shall reauire the review
and approval of the Community Development Dir-
ector.
2. The Planninq Agency hereby grants a conditional
Use Permit, as applied for, to allow for the respite home subject
to the following conditions:
a. Provide concrete driveway apron to replace
existinq asphaltic concrete apron
b. Concrete sidewalk across frontage of property.
c. Modification or replacement of the most
westerly street tree.
d. Proper licensing must be obtained form the
Health Department.

e. Fire Department requirements will be
given once fire clearance request is
received from the Health Department and
an inspection is made.
f. Payment of necessary fees for an investigative
inspection by the Building Official.
g. Facility shall not include parent counseling
or extra activities above a 24 hour child
care center.
h. The facility shall not include any improvements
signage or other modifications inconsistent wit
a residential character.
i. Use shall be subject to annual review from the
date of approval to insure no change in char-
acter or operation has made the facility in-
harmonious with the neighborhood.
PASSED AND ADOPTED at a reaular meeting of the
Planning Agency, held on the 5th day of May, 1980
