HomeMy WebLinkAboutPC RES 1892 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 1892 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AMENDING USE PERMIT 74-9 TO AUTHORIZE INCREASED OFFICE FLOOR AREA AND DRIVE-THROUGH TELLER WINDOWS FOR OFFICE BUILDINGS 3 AND 5 AT ENDERLE CENTER. The Planning Agency of the City of Tusfin does h'ereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application was filed fo amend Use Permit 74-9 on behalf of EMS Development Company fo request authorization fo construct a 33,000 square ¢oo.t office building with three drive- through teller windows and subterranean parking and a 30,000 square foot office building at the'northeast and northwest corners of Enderle Way and Sevenfheenth Street. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use is in substantial conformance with EIR 74-3 and Use Permit 74-9. 2. The use is in conformance with the Land Use Element of the Tusfin Area General Plan and Planned Community Commercial zoning District. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor fo the general welfare of the City o¢ Tusfin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as adm~niste.red by the Orange County Fire Marshal, and street improvement require- ments as administered by the City Engineer. F. Final development plans shall require the review and approval of the Corrrnunify Development Director. Ii. The Planning Agency hereby amends Use Permit 74-9, as requested, to authorize the enlargement of previously approved office buil'dings 3 and 5 with subterranean parking and three (3) drive-through feller windows for building 5, subject to the following conditions: A. All applicable conditions of Resolution No. 1409 shall be complied with. 3. 3 5 6 ? 9 ;LO 15 ;[6 3.? 35 28 B. A detailed gradinG plan for both buildings shall be submitted for review and approval. C. All work within the public right-of-way will require a oermit issued by the Engineering Department. D. Sewer and water laterals shall be shown on the final site 01an. Reference city drawings R.S. 986. E. Development of this parcel shall be in conformance with all previously approved site plans for the Enderle Center development. F. The final site plan shall show the required median construction in Enderle Center Drive and modi¢cation of the drive aisle ,~,idth along the east side of the center(front of liquor store and restaurant). G. Master sign plans shall be submitted for each building orior to the issuance of any permits. Signing shall be limited to the follo~- lng for each building: One (1) 12 sq. ft. building identification sign per structure (no tenant ID). One (1) 6 sq. ft. business identification wall sign per tenant. Commercial wall signing for chartered financial institutions and real estate offices in conformance with existing master signing of the center. H. The owner of the center, by drawing permits based uoon this use permit, acknowledges that a self-imposed hardship of location maybe the'result of the project and that such a hardship may not be grounds for the granting of any sign code variance report .... . I. The owner shall notify all future tenants prior to occupancy of the sign code limitations for the center. J. All roof equipment and vents must be screened from viers. K. One (1) of the stairways from the subterranean parking area of Building 3 shall exit on the shopping center side of the drive through teller window lanes. L. The final site plan shall be reviewed by the Planning Agency prior to the issuance of building permits.
