The Planning Agency of the City of Tusfin does hereby resolve as follows: 1. The Planning Agency finds and determines as follows: A. That a proper application (Variance No. 80-7) was riled on behalf of Ron Weber by t~ark Williams, fo request authorization to vary with the 70' minimum R-3 lot width requirement and develop an existing multiple family lot of 50' in width. B. That a public hearing was duly called, noticed and held on said application. C. That because of special circumstances applicable to the subject property, relative fo size, shape, topography, location or sur- roundings, a strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following.findings'- ao The property was subdivided under County of Orange jut'is- di ct i on. b. The property was subdivided prior fo the enactment of the current zoning classification. D. That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. E. That the granting of the variance as herein provied will not be contrary fo the intent of the zoning ordinance or the public safety, health and welfare, and said variance should be granted. F. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement require- menfs as administered by the City Engineer. G. Final deve. lopmenf plans shall require the review and approval of the Community Development Director. II. The Planning Agency hereby grants a variance as applied for, to permit the construction of a four (4) unit apartment building, subject fo the following conditions: 1. Final development plans fo include, but not be limited fo the grading site, building, electrical, plumbing, and landscaping shall be submitted fo the Building Ot:ficial for review and ap- proval. 2. Street improvements adjacent fo the development along San Juan Street frontage will be required. Curb and gutter c. Sidewalk d. Street trees e. Street lights 3. Connection fo sanitary sewer located in the alley fo the rear o¢ parcel is required. 4.
