RESOLUTION NO. 1877
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A USE PERMIT TO CONSTRUCT
A MUETIPLE BUILDING OFFICE COMPLEX IN THE R-5
DISTRICT.
The Planning Agency of the City of Tustin hereby resolves as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application, Use Permit No. 80-1, was filed by
Gfeller Development Company to request authorization fo con-
sfrucf a multiple office complex of 49,167 square feet gross
floor area, o~ the Stevens property af 228 West Main Street,
with subterranean and detached parking accommodations.
B. That a public hearing was duly called, noticed, and held on
said application.
C. That establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detrimental
to the health, safety, morals, comfort or general welfare of
the persons residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
The proposal and application is in conformance with provisions
of Section 922662 of the City Code.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental fo the propertY
and improvements in the neighborhood of the subject property,
nor fo the general welfare of the City of Tusfin, and should
be granted.

E. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Code as
administered by the building official, Fire Code as administered
by the Orange County Fire Marshal, and street improvement re-
quirements as adminsfered by the City Engineer.
F. That a Negative Declaration has been applied for fo comply with
the requirements of the California Environmental Quality Act and
is hereby granted.
G. Final development plans shall require the review by the Planning
Agency and approval by the Cor~r,unity Development Director.
II. The Planning Agency hereby grants a use permit as applied for, fo
authorize the development of a 49,167 square foot (gross), multiple
building office complex subject fo the Following conditions:
A. The development shall provide no less than 164 parking spaces
which shall be in substantial conformance with the submitted
plan and current development standards.
B. The parking area on the east side of "C" Street shall be tied
to the office parcels on the west side by a recorded covenant
or deed restriction guaranteeing that the parking will not be
sold separate from the office complex.
C. The corners at "B" and "C" Streets require revision. The curb
must be enlarged fo 35' and the appropriate corner cut-Off
dedications to accornmodafe these radii.

The curb should be replaced by the developer, with required street
free removal, or the developer should provide a performance bond
guaranteeing installation at such time when if is determined neces-
sary by the City.
D. An irrevocable offer of dedicafion for a 10' wide strip along the
Main Street frontage shall be executed fo conform to the /t A aster
Plan of Streets and Highways.
E. A pedestrian activated signal shall be provided by the developer
for the detached parking i of on the east side of "C" Street.
F. Street improvement plans shall be submitted prior fo the issuance
of buildin9 permits and construction of improvements for:
:~. The easterly side of "B" Street adjacent fo the site.
.
Installation of Marbelife street lights with underground
conduit along the frontages of "B", Main, and "C" Streets
adjacent fo the development.
G. The payment of sewer connection fees on a portion of the property
(66' x 150') located af the most southwesterly corner of the site
is required prior to building permit issuance.
H. Additional fire hydrants shall be provided as required by the
Orange County Fire Marshal's office. Plans for their installation
and the upgrading of the wafer main shall be submitted to and
approved by the Orange County Fire Marshal, Tustin Water Works,
and the City Engineer.
The parkin9 structure is required fo be protected by an auto-
matic fire sprinkler system. Buiidin9 types B and C are requir'~d
to have Fire detection systems as specified in the Tustin Fire
Code.
I. All roof top equipment shall be screened in a manner consistent
with the architecture.
J. Five (5) parking stalls for the handicapped shall be provided
with at least two (2) provided on the west side of "C" Street,
above ground level.
K. Dense plant screening and a 6'8" masonry wall shall be provided
along the southerly property lines to ensure privacy for the
neighboring residential properf'ies. .
L. Trash enclosures shall be provided af the ends of the drive aisle
of the 21-stall parking area.
The final site-plan for plan check shall show all property lines,
easements, and utility lines, proposed and exisfin9.
N. Signing for the project shall conform to all provisions of the
professional Districts of the Sign Code which authorize:
1 - 12 sq. ft. (single face) center identification sign for each
street frontage.
1 - 6 sq. ff. wall sign per tenant
O. Any subdivision of the properties must conform to provisions

of the Subdivision Ordinance and the resultant lot lines conform
fo setback and separation requirements of the Uniform Building
Code (1976).
P. The developer shall submit all improvement plans and copies
recOrded documents,as required by staff, in a unified set of
plan check documents.
