RESOLUT ION NO. 1872
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL DISPOSITION OF CERTAIN PROPERTY.
The Planning Agency of the City of 'Tustin hereby resolves as
fol 1 ows'
l. The Planning Agency finds and determines as follows-
a. That a proper application was properly initiated by the
Planning Agency for the purpose of determining the need, if
any, for a parcel of land described as a 30' wide strip of
land'westerly of Newport Avenue, between the Orange County
Flood Control District Channel and Irvine Boulevard and as
shown on Exhibits A and B attached hereto.
b. That a' sale of the subject property is in conformance
with the Tustin Area General Plan.
c. That a request for a Negative Declaration has been ap-
pl led for.
d. That the subject property is and should be disposed of
for private use and development for the following reasons-
1. The property is not suitable nor adequate for any
public.purpose to include a park.
2. There is no contemplated use of the property for
public right-of-way, either presently or prospec-
tively.
2. The Planning Agency, pursuant to Section 37350 and 65402 of
the Government Code hereby recommends to the City Council the
disposition by sale of the subject parcel.
PASSED AND ADOPTED at a regular meeting of the Planning Agency.
held on the 21st day of January, 1980.

ALL THAT LAND SITUATED IN THE CITY OF TUSTIN, COUNTY
OF ORANGE, STATE OF CALIFORNIA, DESCRIBED AS FOLLOWS:
Beginning at the point of intersection of the easterly right-of-way line of Holt -
Avenue, an 80 foot wide street as shown on a map of the Vanderlip and Rowan. Tract re-
corded in BoOk 5, Page 160, of miscellaneous records of Los Angeles County, California,
with the northwesterly right-of-way line of the Southern Pacific Railroad as conveyed
in a deed recorded in book 570, page 288, Records of Los Angeles County, California;
Thence, N.O0° 22' 03" W., along said easterly right-of-way line of Holt Avenue,
a distance of 46.59 feet to the point of intersection with a line parallel with and
distant 30.00 feet northwesterly of, as measured at right angles to, said northwester-
ly right-of-way line of the Southern Pacific railroad;
Thence, N.39° 43' 00" E., along said parallel line, a distance of 402.29 feet to
the point of intersection with the easterly right-of-way line of the Orange County
Flood Control District easement as per deed recorded in book 5670, page 846 of Official
Records of Orange County, California, said point of intersection being the true point
of beginning of the parcel to be described;
Thence, N.39° 43' 00" E., along said parallel line, a distance of 198.44 feet to
the northarly line of the land conveyed to Raymond C. Barnes and Nila M. Barnes as per
deed recorded in book 292, page 220 of deeds, Records of Orange County, California;
Thence, N.89° 36' 53" E., along said northerly 'line, a distance of 39.22 feet to
the point of intersection with the previously mentioned northwesterly right-of-way
line of the Southern Pacific Railroad;
Thence, S.39° 43' 00" W., along said northwesterly right-of-way line, a distance
'-I of 259.34 feet to the point of intersection with the previously mention easterly right-
of-way line of the Orange County Flood Control District easement;
Thence, N.O0° 22' 03" W., along said easterly right-of-way line, a distance of
q6.59 feet to the true point of beginning.
