HomeMy WebLinkAboutPC RES 1867lO 12 19 20 22 25 25 2? 28 2.9 %0 RESOLUTI ON NO· 1867 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, GRANTING A USE PERMIT TO AUTHORIZE THE CONSTRUCTION OF A PROFESSIONAL OFFICE CONDOMINIUM. The Planning Agency of the City of Tusfin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application, Use Permit 79-24, was filed on behalf of the Wellington Group for authorization to construct a profes- sional office condominium on the northwest corner of Plaza Drive and Irvine Boulevard, Lot 11, Tract No. 8475. B. That a public hearing was duly called, noticed, and held on said application. C. That establishment, maintenance and operation o¢ the use applied for will not, under the circumstances of this case, be detfri- mentat fo the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The is in conformance with the Land Use Element of the Tusfin Area General Plan. 2. The plans conform to the provisions of Specific Plan No. 4, as adopted by Ordinance No. 606. D. Tha~ the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor fo the general welfare of the City of Tusfin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Orange County Fire Marshal, and street im- provement requirements as administered by [he City Engineer. F. That the project is categorically exempt from provisions of the California Environmental Quality Act. G. Final development plans shall require the review and approval of the Community Development Department. II. The Planning Agency hereby grants a use permit, as applied for, to authorize the construction of a 27,500 square foot office condominium project at 14751 Plaza Drive, subject fo the following conditions: A.. The developer shall have a civil engineer prepare and/er revise existing improvement plans for Plaza Drive and Plaza Way fo show the construction of and shall construct all missing or damaged street improvement adjacent to said development per the City Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards." Construction of 9' x 4" (measured from back of curb) full width sidewalk with 4' x 4' tree wells at 40' on center of Plaza Way and Plaza Drive. The City will reimburse the de- veloper for 5' of sidewalk width only. 2. Closure of existing and construction of new driveways and aprons per City Standard 108B. B. Developer shall be required to make a payment of $50 per tree to the City for planting of street trees at 40' on cenfer'for both the Plaza Drive and Plaza Way frontages. C. All public improvements to be constructed in conjunction with this development shall be completed prior fo the issuance of any Certifi- cates of Occupancy. D. A detailed grading plan, showing the disposition of all drainage, shall be submitted for review and approval. E. Payment of sewer connection fees per the Orange County Sanitation District No. 7 Ordinance. F. Installation of all utiltiies underground in connection with this development with no poles being set either on or adjacent to the subject development. G. Review and approval by Orange County Flood Control District for improvements shown on the Flood Control District right-of-way. H. Review and approval by Orange County Flood Control District ap- proving the location of the office building with respect to Flood Control District right-of-way and the box culvert structure shall be required. I. All s~reet lights, fire hydrants, and catch basins shall be plotted on the final site plan fo determine if any conflicts exist with proposed drive locations. J. That the formation of a "Corrrnunity Association" and approval of the community covenants, conditions, and restrictions is required. The Association and CC&Rs shall include the following: 1. Provide for the maintenance of common areas and the landscaping along street frontages. 2. Provide for the maintenance service and payment of charges for the fire detection and sprinkler systems fo include expansion of service upon improvements or alterations of tenant units, if if is determined by the Orange County Fire Marshal's office fhaf such systems are required. 3. Numbered parking spaces shall be allocated for each tenant space, based upon square footage requirements of the Tustin Zoning Code. 4. That the CC&Rs will include, but not be limited to, dis- closure of management agreements, maintenance provisions, access for emergency repairs, easements, etc. so future purchasers will be aware of some problems which might occur. 5. That all tenants, regardless of type of professional specialty, shall conform to the requirements of the Professional District of the Tustin Sign Code and of the design restrictions of a Master Sign Plan submitted by the developer and approved by the Community Development Director.
