HomeMy WebLinkAboutPC RES 18631 2 5 10 1! !2i, 24 25 26 2? 28 29 30 32 RESOLUTION NO. 1863 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, APPROVING USE PERMIT 79-37 AUTHORIZING THE EXPANSION OF A SANDWICH SHOP AT 15471 RED HILL AVENUE, UNIT D. The Planning Agency of the City of Tusfin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. A proper application (Use Permit 79-37) has been filed on be-- half of Torn and Jerry's Sandwich Shop. for the expansion of a take-out sandwich and salad shop on a portion of the Red Hill Business Center, on Red Hill Avenue. ' B. That a public hearing was duly called, noticed, and held on said application. C. That establishment, maintenance and operation o¢ the use. applied f-or will not, under the circumstances of this case, be detrimental to the health, safety or general welfare of the persons residing, or working in the neighborhood of such pro- posed use, evidenced by the following findings: 1. That said development is in conformance fo the Tusfin Area General Plan. 2. That perimeter landscaping has been provided around the ex- terior of the complex, with median planter islands in the interior drive aisles. 3. That said development will be compatible with the total master planned complex within which the development is located. D. That the establishment, maintenance and operation of the use appl.ied for will not be injurious nor detrimental to the property and improvements in the neighborhood of the subject property, nor fo the general welfare of the city of Tustin, and should be 9ranted. E. Proposed development shall be in accordance with the develop- ment policies adopted by the City Council, Uniform Buildin9 Codes as administered by the Buildin9 Official, Fire Code as administered by Orange County Fire Marshal, and street irn- provement requirements as administered by the City Engineer. F. That the development is categorically exempt from the re- quirements of the California Environmental Qualify Act. G. Final development plans shall require the review and approval of the Community Development Department. Ii. The Planning Agency hereby grants a Use Permit to expand the op- eration of a sandwich shop within the Red Hill Business Center as applied for, subject fo the followin9 conditions: A. Ali inferior improvements shall comply with all applicable City building regulations. B. Hours of operation shall be not earlier than 6 a.m. nor later t-ban 7 p.m. Monday through Saturdays. C. Promotion of the facility for other than resident tenants shall be a violation of the Use Permit. D. The operation shall comply with Sign Ordi'nance No. 68~ and the Mas[er Sign Plan for the Center, E. Approval of the County Health Department shall be required for food service facilities. - F. Billiard tables, pinball games, or other electronic amusement ' devices are not permitted under this Use Permit. .. ' G. Seating capacity shall be limited to 24 seats total for the entire facility.
