RESOLUTION NO. 1862
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A SETBACK VARIANCE TO WALTER
FOSTER FOR THE PROPERTY AT 4.50 WEST SIXTH STREET.
The Planning Agency of the City of TUstin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows=
A. That a proper veriance application I79-7) was filed on behalf
of Walter Foster for authorization to vary with the rear set-
back (lO'l provisions of the Planned Industrial District
IPMI, on the property located at 430 West Sixth Street.
B. That a public hearing was duly called, noticed, and held on
said application.
C.. That because of special circumstances applicable to the subject
property, relative to size, shape,.topography, iocafion,.or
surroundings, a strict application of the zoning ordinance
is found to deprive the subject property of privileges enjOyed
by other proper.ties in the vicinity, and under identical zone
classification, evidenced by the following findings:
The abutting of the rear yard area to the Santa Ana Free-
way results in the area bein9 undesirable for use by em--
ployees for an outdoor landscaped rest area due to noise.
The rear yard area would be a hardship to maintain, being
isolated with no proposed rear exits from the building.
D. That the granting of a variance as herein provided will not
constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and district
in which the subject property is situated.
E. That a negative declaration of environmental impacts is approved
by this actior~.
F. That the granfin9 of the variance as herein provided will not
be contrary fo the intent of the zonin9 ordinance or the public
safety, health and welfare, and said variance should be 9ranted.
G. Proposed development shall be in accordance with the develop- .~

ment policies adopted by the City Council, Uniform Building ...-
Codes as administered by the Building Official, Fire Code as :.. :';
administered by the Orange County Fire Marshal, and street ~
improvement requirements as administered by the City Engineer ;2':

H. Final development plans shall require the review and approval · '-:-.-.'-

II. The Planning Agency hereby grants a variance a's applied for, fo
permit a one foot (l') rear yard setback at 430 West Sixth Street,
subject fo the following conditions:
A. That final development plans shall conform fo all applicable

provisions of the Uniform Building Code, 1976 edition.
The site plan shall include locations of sanitary sewer lateral
and domestic water service. All frees, fire hydrants, utility
poles, etc. within the public right-of-way and adjacent to
the subject parcel should be located so fhaf any potential
conflict with the proposed driveways can be reviewed.
C. The the complete planting and irrigation plans shall be sub-
miffed for review and approval with the following tree plant-
ing requirements:

4 - twenty-four inch box frees
9 - fifteen gallon frees
The increase in quantify of 24" box trees is required as a
mitigating measure of the environmental impact of losing mature
frees due fo development,
