RESOLUTION NO. 1857
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING USE PERMIT 79-32 ON APPLI-
CATION. OF ATLANTIC RICHFIELD COMPANY FOR A MINI
MARKET WITH SELF-SERVE GASOLINE.
The Planning Agency of the City of Tustin-does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (use Permit 79-32) was filed by
Atlantic Richfield Company to authorize the construction of a
mini mart retail store with a self-serve gasoline station and
attendant operator, including other property improvements located
at 14231 Red Hill Avenue.
B. That a public hearing was duly called, noticed and held on said
appl ica t ion.
C. That establishment, maintenance and operation of the use applied
for will not,~ under the circumstances of this case, be detrimental
to the health, safety, morals, comfort or general welfare of the
persons residing or working in the neighborhodd of such proposed
use, evidenced by the following findings:
1. That subject use is in conformance to the Tustin General
Plan as adopted by the City Council of Tustin; and
2. That the development will be constructed in accordance with
an approved plan for the building and site.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property, nor
to the general welfare of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the Zoning Ordi-
nance and the development policies adopted by the City Council,
Uniform Building Codes as administered by the Building Official,
Fire Code as administered by the Orange County Fire Marshal, and street
improvement requirements as administered by the City Engineer.
F. That the development is categorically exempt from the requirements
of the California Environmental Quality Act.
Ii. The Planning Agency hereby grants a use permit as applied for to authorize
a mini-mart retail store with self-serve gasoline sales, subject to
the following conditions-
1. That necessary permits be obtained for all construction, and
all work be accomplished in conformance with current codes.
2. That the development of the subject property shall be done in
co~formance with all applicable codes and standards, to include
the City of Tustin Development Standards (Resolution 78-78),
the Zoning Ordinance (Ordinance 157), and the Sign Ordinance
(Ordinance 684).
3. That final development plans to include plot, elevations,
materials, lighting, and signing be submitted for review and
approval by staff.
4. Installation of all utilities underground with no additional

overhead poles to be set within the property or adjacent to
street right-of-Way. ' ,.
5. Installation of street, improvements to the approval of the City
Engineer, which include:
a. Annexation to the Tustin Lighting District.
b. Installation of Marbelite street lights with underground
conduit.
c. Replacement of all missing or damaged street improvements,
including but not limited to sidewalk, curb and gutter,
and drive aprons.
6. Landscaping will be upgraded to conform to minimum requirements
of the landscaping and parking development standards.
7. That any servicing or repair of vehicles should no longer be
permitted.
8. That said use shall be conducted so as not to present a
nuisance to the public or adjoining property owners in regard
to noise, litter, and public health.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City
of Tustin, held on the 19th day of November , 1979.
