RESOLUTION NO. 1856
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING USE PERMIT 79-33, ON APPLI-
CATION OF MOBIL OIL CORPORATION FOR THE CONSTRUCTION
OF TWO, 22' DIAMETER CANOPIES OVER TWO ISLANDS.
The Planning Agency of' the City of Tustin does hereby resolve as follows:
I. The Pl~mning Agency finds and determines as follows:
A. That a proper use permit (Use Permit No. 79-33) was filed by
Mobile Oil Corporation, to authorize the construction of two
22' diameter canopies over two islands, including other property
improveme_nts, located at 171 East First Street.
B. That a public hearing was duly called, noticed, and held on
said application.
C. That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this Case, be
detrimental to the health, safety, morals, comfort of general
welfare of the persons residing or working in the neighborhood
of such proposed use, evidenced by the following findings:
1. That subject use is in conformance to tke Tu~;tin General
Plan as adopted by the Ctiy CouLncil of Tustin; and
2. That the development will be constructed in accordance w~th an
approved plan for the building and site.
D. That the establishment, maintenance and operation of the use applied
for will not be injurious or detrimental to the property a~nd im-
provements in the neighborhood of the subject property, nor to thc
general welfare of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the Zoning Ordi-
nance and the development policies adopted by the City Council,
Uniform Building Codes as administered by the Building Official,
· r~n~l, and
Fire Code as admin?~stered by the Orange Co~u~.ty Fire' Ma ~ ·
street improvement requirements as administered by the City
Engineer.
F. That the development is categrocia!ly exempt from the requirements
of the California Environmental Quality Act.
Ii. The Planning Agency hereby grants a Use Permit as applied for to
authorize the construction of two 22' diameter canopies over two
islands and other improvements subject to the following donditions:
A. That necessary permits be obtained for all construction, and all
work accomplished in conformance with current codes.
B. That the development of the subject property shall be done in
conformance with all applicable codes and standards j to include the
City of Tustin Development Standards (Resolution 78-78~, the-Zoning
Ordinance (Ordinance 157), and the Si~n Ordinance (Ord. 684).
C. Prior to issuance of the building permits:
1. The rotor for the free-standing sign will be removed per

Ordinance 684, Article IV, Sec. 5E.
2. Removal of the leased billboard on the westerly property line
per Ordinance 684,. Article XI, Sec. 3.
D. Installation of all utilities underground with no additional over-
head poles to be set within khe property or adjacent to street
right-of-way.
E. Installation of street improvements to the approval of the City
Engineer.
1. Install any Marbelite street lights with underground conduit
which may be required.
2. Replacement of any damaged or missing street improvements,
including but not limited to sidewalk, curbs, and gUtter,
drive aprons, etc.
F. That said use shall be conducted so as not to present a nuisance
to the public or adjoining property owners in regard to noise,
litter, and public health (odors, etc.).
PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City
of Tustin, held on the 19th day of November , 1979.
