A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, APPROVING USE PERMIT N0. 79-31,
AUTHORIZING AN INDOOR ANIMAL BOARDING FACILITY
AND KENNEL AT 15451-A RED HILL AVENUE.
The Planning Agency of the City of Tustin does hereby resolve as follows:
~ I. The Planning Agency finds and determines as follows:
A. That a proper application (Use Permit 79-31j was filed on behalf
of Timothy J. Scott for a Conditional Use Permit to allow an
indoor animal boarding and kennel facility at 15451-A Red Hill
Avenue.
B. That a public hearing was duly called, noticed and held on said _
application.
C. That. establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detri-
mental to the health, safety, morals, comfort or general welfare
of the persons residing or working in the neighborhood of such
proposed use, evidenced by the following findings
1. The application and use is in conformance with the Zoning
Code as interpreted by the Planning Agency.
2. The use is categorically exempt from the California Environ-
mental Quality Act.
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should be
granted.

E. Proposed development shall be. in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Orange Comity Fire Marshal, and street improvement require-
ments as administered by the City Engineer.
F. Final development plans shall require the review and approval of
the Community Development Director.
II. The Planning Agency hereby grants a Conditional Use Permit, as applied
for, to authorize an indoor animal boarding and kennel facility, subject
to the following conditions:
A. That the use shall con form to all appropriate health and animal
regulations of the County of Orange and the State of California.
B. That the owners of the Center shall guarantee to the City proper

installation of-the Valencia Avenue driveway prior to the issuance
of any tenant improvement permits.*
C. That the operator of the kennel shall keep the facility clean to
ensure a healthy and odor free environment for neighboring tenants.
D. The operator of the kennel shall provide noise attenuation features,
if needed, within the facility to ensure that neighboring business
activity is not disturbed by excessive animal noise.
L. That at no time is the storage of animals, equipment, or supplies
outside of the building authorized.
