RESOLUTION NO. 1850
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING A CONDITIONAL USE
PERMIT FOR THE OPERATION OF A FAST FOOD
ESTABLISHMENT WITH DRIVE-UP WINDOW AT THE
SOUTHEAST CORNER OF 17TH STREET AND ENDERLE
WAY.
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (Use permit 79-29) was filed by Hal
Solomon on behalf of Westco Food Services, Inc., requesting the
authority to operate a restaurant with a drive-up window at
17502 17th Street, southeast corner of 17th Street and Enderle
Way.
B. That a public hearing was duly called, noticed, and held on said
applicat ion.

C. That establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detrimental
to the health., 'safety, morals, comfort or general welfare of the
persons residing or working in the neighborhood of such proposed
use, evidenced by the following findings:
1. The proposed use is in conformance with the Land Use Element
of the Tustin Ar, ea General Plan.
2. That the use is in subst~mtial conformance with Use Permit
74-9 which authorized the construction of Enderl~ Center.
D. That the establishment, maintenance and operation of the use applied
for will not be injurious or detrimental to the property and im-
provements in the neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the development
policies adopted by the City Cottncil, Uniform Building Code as
administered by the Building Official., Fire Code as administered
by the Orange County Fire Marshal, and stre.~t improven%ent re-
quirements as administered by the City Engineer.
F. That an environmental impact report (EIP, 74-3) was certified for
the development of the property.
G. Final development plans shall require the review and approval of
the Connnunity Development Director.
II. The Planning Agency hereby grants a use permit, as applied for, to
authorize the operation of a restaurant with a drive-through window,
subject to the following conditions: ..
A. That based upon the parking spaces provided, the restaurant can be
authorized 88 seats for satisfying zone requirements, but the seat-
ing must comply with all applicable provisions of the 1976 Uniform
Building Code.
B. That left turn movements to and from the new Enderle Way driveway
and the 17th Street driveway be prohibited and the developer shall
provide on-site traffic control devices or driveway modifications
to the satisfaction of the City Engineer to ensure complia3%ce.

C. That the centerline of the 17th Street driveway will be 17.5
feet from the eastern property line, to conform to City standards.
D. That the development is authorized two 25 square feet wall signs
as applied for. Any othe~ sign must comply strictly with pro-
visions of Sign Code 684. No free-standing business identification
signs can be authorized under provisions of the present regulations.
E. That planting and irrigation plans be submitted for review and
approved by the Community Development Department. Tree planting
quantities for this development are as follows:
4 - twenty-four inch box specimens
26 - fifteen gallon specimens
F. That the exterior wood treatment shall be carried along the rear
portion of the building.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning Agency, held
on the 19th day of November , 1979.
