RESOLUTION NO. 1846
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN RECOMMENDING TO THE CITY COUNCIL
DISPOSITION OF SURPLUS ROAD RIGHT OF WAY ON SIXTH
STREET EASTERLY OF THE SANTA ANA FREEWAY
The Planning Agency of the City of Tustin does hereby re-
solve as follows-
1. The Planning Agency finds and determines as follows-
a. That a proper application was filed by the Planning
Agency for the purpose of determining the needs, if
any, of public right of way known as Sixth Street
as described by Exhibit "A", attached hereto and
incorporated herein by this reference as set forth
herein in full.
b. That the subject property should be declared ex-
cess to the City's needs and disposed of for pri-
vate development for the following reasons-
l) The road alignment and configuration of Sixth
Street has been established with approved im-
provement plans for their ultimate alignment
which vacates subject area.
2) The property is not suitable nor adequate for
other public purposes, such as parks or recre-
ational needs.
3) There is no known use of the prope.rty as stre~
right of way.
C. That pursuant to Section 8330 of the Streets and
Highways Code for the State of California, it is
possible to reserve public interest in easements
for sewer, storm drains, and utility purposes.
d. That the Agency recommends the vacation of the ease-
ment for street purposes to the adjoining property
owners without fee.
e. Subject project is exempt from an Enviromental Im-
pact Report on the bas,is that this proposed action
is categorically exempt.
f. That the vacation of the subject street right of way
wil.~l be in conformance wi th the City of Tustin Gen-
eral P1 an.
2. The planning Agency, pursuant to Sections 37350 and
65402 of the Government Code, hereby recommends to the
City Council the declaration of the subject parcels as
excess to the needs of the City and its disposition to
the adjoining property owners with the reservation of
easements to conduct, maintain, operate, replace, re-
move and renew those facilities necessary for storm
drain, sewers, and public utilities.
