RESOLUTION NO. 1843
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING A CONDITIONAL USE
PERMIT ON APPLICATION 79-26.
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (Use Permit 79-26) was filed on
behalf of Thomas Prescott for a conditional use permit to
authorize the outdoor sales of fruits and vegetables, grown
on the premises, together with produce grown by the applicant
on other fields in the Tustin community.
B. That a public hearing Was duly called, noticed and held on
said application.
C. That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort, or
g~-neral welfare of the persons residing or working in the
neightborhood of such proposed use, evidenced by the following
. ~-:-_n dings:
i. The use is in conformance with the land use element of
the Tustin Area General Plan.
2. That outdoor sales are allowed in the C-2 zone with a
conditional use permit.
3. That this project is categorically exempt from the pro-
visions of the Californi~ Environmental Quality Act,
Class IV (5).
D. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should
be granted.
II. The Planning Agency hereby grants a conditional use permit, as
applied for, to allow the outdoor sales of fruits and vegetables
for Thomas Prescott at property located 150' northerly of Sixth
Street on E1 CAmino Real, subject to the following conditions:
A. The tempQrary facility shall remain in its present location or
not be located closer to the public right-of-way.
B. The off-street parking area shall be oiled whenever necessary
to control dust and weed growth.
C. All signs need approval from the Community Development Depart-
ment and the appropriate permits.
D. Approval of this use permit as a temporary facility shall be
subject to annual review by the Planning Agency.
E. Any expansion over that indicated on the approved site plan
would necessitate the filing of a new use permit.
F. Prior to issuance of a business license a five hundred dollar
($500) bond shall be posted with the Director of Community
Development to guarantee removal of temporary stands upon

termination of the use, and to guarantee maintenance of the
property. Said bond shall be accompanied by a signed agree-
ment which shall allow the City to enter upon the premises
to remove the building or structure if it becomes.a nuisance,
a hazard, or is in disrepair.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning Agency,
held on the 1st day of October, 1979
