A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUST!N, GRANTING A USE PERMIT TO AUTHORIZE THE OPEP~TION OF A TEP~4POP~RY BkNK FACILITY FROM A MOBILE BUILDING. . .i The Planning Agency of the City of Tustin does ~ereby resolve as follows: I. The Planning Agency finds and determines as follows:. A. That a proper application, Use Permit No. 79-17, was filed on behalf of Far Western Bank to request authorization to operate, from a mobile building, a temporary bank .facility with' a drive-up ..~ teller window at the southwest corner 0f Walnut Avenue and Frank- lin Avenue, as shown in Exhibits "A", "B", and "C" attached hereto and incorporated herein by this reference as though set forth here- in in full; B. That a public hearing was duly called, noticed and held on said application; C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing Or ,..;or.king in the neighborhood of such proposed use, evidenced by the following findings: i. The use is in conformance with the Tustin Area General Plan. 2. The application is in conformance with Section 9270c of the Tustin'City Code. D. That the establishment, maintenance and operation of the use pp!ied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be grantod. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement require- ments as administered by the City Engineerr F. Final d~velopment plans shall require the review and approval of the Community Development Director. II. The Planning Agency hereby grants a use permit, as applied for, to authorize a temporary bank facility, subject to the following conditions: _- 1. The term of occupancy shall be limited to six (6) months with ' -' the option of a six months extension by the Planning Agency on application of the owner, without notice and public hearing. · . . 2. That the requirements of the Building, Fire, Engineering, and Planning Departments be .complied with in the use and occupancy of the trailers. 3. That the trailers shall be provided with undercarriage skirts. 4. That the lease of the site shall be for-building footprint and the use of the surrounding land for parking and lanscaping purposes. That all utility service fees shall be paid for tha enti~' 9.75 acre site. Se That all utility plans for work to be performed withim the public right of way shall be reviewed and approved by the City Engineer. . . e e That no other use, temporary or p~rmanent, i~ permitted on : the parcel without submittal of a parcel map. That no further improvement permits will be authorized for the parcel until the temporary facility is removed. That the approval of the on-site work in conjunction, with this development does not Constitute approval of their use for any future development proposals. · . !0. That all signing shall be in conformance with provisions of the .Sign Code.
