The Planning Agency of the City of Tustin does hereby resolve as follows: · I. The Planning Agency finds and determines as follows: A. That a proper use permit application was filed on behalf of Radiation Sterilizers, Incorporated, requesting authorization to operate a Cobalt-60 radiatio.~ sterilization facility as applied.~. for, at 1401 Morgan .Circle. ~ B. That a public hearing was duly called, noticed and held om said application; C. That establishment, maintenance, and operation of the use applied for will not, under the. circumstances of ths case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use permit procedure is in conformance with pro,~isions of the Safety Element of the Tustin Area General Plan. 2. Tine use is in conformance with the Land Use Element of the Tustin Area General Plan ~nat the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be inaccordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by ~he Orange County Fire Marshal, and street improvement re- quirements as administered by the City Engineer. II. The Planning Agency hereby grants a conditional use permit, as applied for, to authorize the operation of a radiation sterilization facility subject to the following conditions: · A. That the violation of laws, regulations, or rules of any regu- latory agency which has control over radiation uses is a violation of the authorization of this use permit. B. That the applicant shall notify the City of any violation of the conditions of operation which are placed upon the facility by a regulatory agency. C. That the applicant shall provide to the City copies of any accident reports which are provided to regulatory agencies. Upon receipt of such reports, the Planning Agency may hold a use permit amend- ment hearing to determine if additional safety measures are needed- D. The applicant shall immediately report any radiation related acci- dent, injury, or exposure, to the Tustin Police Department; the operator shall inform the Police Department of the receipt or re- moval of radioactive material from ~he site 24 hours prior to its transportation. 10 1i Resolution No. 1830 page 2. 16 M.I. That any future regulations concerning the radio!ogical operation placed upon the facility by any governing agency shall also be a condition of the use permit. F. That the shipment to and from the site of any radioactive material shall not be permitted on any surface street in the city northerly of Edinger Avenue/Moulton Parkway. That the applicant shall polic, its supplier of radioactive material t.o insure compliance. · . G. That the applicant shall maintain the proper licenses required to operate such a facility and the conditions of licensing approval are conditions of approval of this permit. The City shall be pro- vided with a copy of the license. · . H. That the applicant shall maintain an emergency plan which will encompass the latest safety techniques in the radio!ogical field.
