HomeMy WebLinkAboutPC RES 1825 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 25 24 25 26 27 28 29 3O 52 RESOLUTION NO. 1825 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, GRANTING A USE PERMIT TO AUTHORIZE THE CONSTRUCTION OF AN INDUSTRIAL CONDOMINIUM. The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application (Use Permit 79-14) was filed on behalf of Robert Goodman, Incorporated for a use permit to authorize con' struction of an industrial condominium on the property described in Exhibit ,,A,, attached hereto and incorporated herein by this reference as tho.ugh set forth herein in full. B. That a public hearing was duly called, noticed, and held on said application. C. That establishment, maintenance and operation of the use applied .. for will not, under the circumStances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the' persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use is in conformance with the Land Use Element of the Tustin Area General Plan. 2. The plan conforms to provisions of the Planned Development Guidelines for th& Irvine Industrial Complex. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development poliCies adopted by the City Council, Uniform Building Codes as a~ministered by the Buildng Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement require- ments as administered by the City Engineer. F. That an Environmental Impact Report was previously certified for the Irvine Industrial Complex (EIR 73-1). G Final development plans shall require the review and approval of the Community Development Department. II. The Planning Agency hereby grants a use permit, as applied for, tO authorize an industrial condominium project at 2681-2712 Dow Avenue, subject to the following conditions: A. The developer shall have either a parcel map or tract map prepared and recorded with the County Recorder. B. The developer shall have a civil engineer prepare and/or revise existing improvement plans for Dow Avenue (refer to'Plan No. RS-918F) to show the construction of and shall construct all missing or damaged street improvement adjacent to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards." 5 6 '7 8 9 10 11 12 13 14 15 16 17 18 !9 20 21 22 2~ 24 25 26 27 28 29 30 31 32 /.,,3' Resolution No. 1825 page 2. C. Ail public'improvements to be constructed in conjunctio~ with this development shall be completed prior to the issuance of any Certificates of Occupancy. D. A detailed grading plan, showing the d.isposition of all drainage, shall be submitted for review and approval. E. Payment of sewer connection fees per the Orange County Sanitation District No 7 Ordinance ' · · -_- -' F. Installation of all utilities underground in connectiom with this development with no poles' being set either on or adjacent to-the subject development. G. The most westerly drive shall be used as a joint access drive' with a reciprocal access easment agreement between the owners of this development and the owner of the development located adjacent and to the west. H. That the developer shall provide testimony from the Irvine In- dustrical Complex (the original subdivider) that the proposed railroad easement across the northerly 12.5 feet of the two lots is no longer required. I. That the westerly driveway shall be constructed with this development. Traffic control devices, stop signs, shall be provided at blind intersections. J. That final development plans shall show all public utilities and sewer connections within the public right-of-way. K. That fire sprinkler and fire detection systems shall be provided as required by the Tustin Fire Code. L. That the formation of a "Community Association" and approval of the community covenants, conditions, and restrictions is required. The Association and CC&Rs shall: 1. Provide for the maintenance of common areas and the lands- caping along Dow Avenue 2. Provide for the maintenance service~and payment of charges for the fire detection and sprinkler systems to include expansion of service Upon improvements or alterations of tenant units. M. That the CC&Rs shall allocate the maximum area uses authorized for each unit based upon the parking provided for the entire complex. N. That individual parking spaces shall be reserved for each unit in the CC&Rs, based upon the units' proposed use. O. That a perpetual easement be provided for all utilities (sewer, water, telephone, gas, electricity, heating, and air conditioning, etc.) P. That the CC&Rs will include, but not be limited to, disclosure of management agreements, maintenance provisions, access for emergency repairs, easements, etc. so future purchasers will be aware of some problems which might occur. Q. That all roof and sideyard mechanical equipment shall be screened from view. S. That a master sign plan shall be submitted for the complex, in accordance with provisions of Section 9496 of the Tustin City Code.
