RESOLUTION NO. 1823
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING A USE PERMIT
.(NO. 79-13) OF HON DEVELOPMENT COMPANY FOR
A COMMERCIAL SHOPPING CENTER.
The Planning Agency of the City of Tustin does hereby .resolve as follows:
I. The Planning Agency of the City of Tustin finds and determines as follows::.
A. That a proper application (No. U.P. 79-13) was filed by Hon De-
velopment Company, 25200 La Paz, Laguna Hills, California 92653,
for an amendment to a use permit to allow the construction a.nd
operation of a shopping center for the property located on the
property bounded by the Newport Freeway on-ramp, McFadden Avenue,
and Tustin Village Way.
B. That a public hearing was duly called, noticed and held om said
appl icat ion.
C. That establishment, maintenance and operation of the use applied for
will not, under the circumstances of this case, be detrimental to
the health, safety, morals, comfort or general welfare of the
persons residing or working in the neighborhood of such proposed
use, evidenced by the following' findings:
The proposed use is in conformance with the Land Use Element of
the Tustin Area General Plan and the Commercial Zoning of the
parcel.
D. That the establishmenb, maintenance and operation of the use appliec~
for will not be injurious or detrJ_mental to Rhe property and
improvements in the neighborhood of the subject property, nor to
th~ general welfare of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the Zoning Ordi-
nance and the development policies adopted by the City Council,
uniform Building Codes as administered by the Building Official,
Fire Code as administered by the Orange County Fire Marshal, and
street improvement requirements as administered by the City Engineer.
F. That the proposal has been addressed by Environmental Impact
Report No. 77-2 as amended and approved by the Planning Agency-
II. The Planning Agency hereby grants a use permit, as applied for, to
allow the construction and operation of a shopping center, subject to
the following conditions:

A. That compliance with items 2A, 2C, 2F, and 2H of Resolution No. 1633
shall be required.

B. That public improvement plans, grading and site plan~s shall be
submitted for review and approval to the City Engineer to in-
clude the following:
1. Show the 15 feet of additional right-of-way to be dedicated
along Tustin Village Way.
2. Show the existing 15 foot wide sewer easement along the southerly
side of "building 2." Also show said sewer.'
3. The sewer easement conflict with the location of "building 2"
on the plan shall be resolved in a manner acceptable to the
Community Development Director-

4. Show the existing street light adjacent to the most northerly
driveway.
5. Show water and sewer service for each parcel.
6. The "proposed raised median," as ~hown on the site plan is .;.

7. Label "proposed raised median" on McFadden Avsnue to be conL
structed as part of this development.

8. A reciprocal access agreement between parcels 1 and 2 will be
included in the CC&Rs. The CC&Rs shall be reviewed by the
City attorney.
9. The developer shall have a civil engineer prepare and/or re-
vise existing improvement plans for Tustin Village Way and
McFadden Avenue (refer to Plan No. R'583) to show the con-
struction of and shall construct all missing or damaged street
improvements adjacent to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street Im-
provement Standards."
10. Place a note on the final plan stating "all work within the
public right-of-way will require a permit from the City of
Tustin Engineering Department."
11. The developer shall obtain a letter from Caltrans stating.that
Ca!trans will accept the storm water run-off from the pro-
posed development prior to the issuance of a grading permit.
C. That the installation of an on-site fire hydrant capable of pro-
viding 1500 gpm at 20 psi shall be provided in addition to the
existing hydrant.
D. That fire sprinkler system shall be provided for the 25,000
square feet building and fire detection systems for the buildings
in excess of 5,000 square feet.
E. Compliance with mitigation measures proposed by EIR 77-2, as amended,
to include but not limited to:
The submittal and approval of landscape plans to the satisfaction
of the Community Development Department.
F. That signing shall be authorized in conformance with the following:
1. Wall sign shall be permitted as provided in the approved Master
Sign Plan (Exhibit "B").
2. A center identification freeway sign of 120 square feet (40'
in height), as contained in Exhibit "B". The sign background
shall be of a uniform color. That any future tenant freeway
identification request shall.be included on the approved pole
sign with the maximum sign area of 160 square feet and any
future additions shall provide identity for all remaining
tenants.
3. That the owner of the Center approves the master sign plan as
submitted and amended by this action, and as property owners
shall authorize no signing in variance with approved =~ster
sign plan.
G. That enlarged trash enclosures shall be provided at the rear of
Building No. 1.

H. That additional on-site parking shall be provided in conformance
with zoning and development standards if the 10,000 square foot
building area, which has parking allocated at a one (1) space
per 400 square feet gross floor area, is occupied by a use other
than a furniture store, home lighting ~tore, or qarpeting and
tile store.
I. That all roof top .and side wall mechanical equipment shall be
screened from view. ~
J. That delivery truck usage shall be limited to ingre.ss via Tustin
Village Way. A sign at the McFadden entrance, prohibiting delivery
vehicles, shall be provided.
K. That the developer shall provide a left turn arrow at the McFadden
and Tustin Village Way intersection, as approved by the City
Engineer, or a letter of credit shall be filed with the City for
the'amount 'required to complete such work.
PASSED AND ADOPTED at a regular meeting of the Planning Agency held on the
4th day of June, 1979.
