RESOLUTION NO. 1822
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A USE PERMIT ON APPLICATION
NO. 79-15, AUTHORIZING THE OPERATION OF A
CHILDREN'S PRE-SCHOOL AT THE FIRST BAPTIST CHURCH
OF TUSTIN.
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (Use Permit 79-15) was filed on behalf
the First Baptist Church of Tustin, for a conditional use permit
to allow the operation of a children's pre-school on the property
described in Exhibit "A" attached hereto and incorporated herein
by this reference as though set forth herein in full.
B. That a public hearing was duly called, noticed and held on said
application.
C. That establishment, maintenance, and operation of the use applied
for will not, under the circumstances of this case, be detri-
mental to the health, safety, morals, comfort or general welfare
of the persons residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
The use is in conformance with provisions of the City Zoning Ordi-
nance and with the Land Use Element of the Tustin Area General
Plan.
D. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
or imp_rovements in the neighborhoOd of the subject property, nor
to the general welfare of the City of Tustin, and should be
granted.
E. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Orange County Fire Marshal, and street improvement re-
quirements as administered by the City Engineer.
F. Final development plans shall require the review and approval of
the Community Development Department.
G. That this project is categorically exempt from the requirements
of the California Environmental Act.
II. The Planning Agenuy hereby grants a conditional use permit, as applied
for, to allow the operation of a pre-school at the First Baptist
Church of Tustin, subjeCt to the following conditions:
A. The structures which are to he used as classrooms must comply
with provisions of Chapter 8 and E-3 type occupancies of the
uniform Building Code (1976 edition). Plans of the buildings
shall be submitted to the Building Official for review to assure
compliance.
B. That the use should comply with all state and county regulations
for private pre-schools.
C. That a fire safety inspection will be required upon receipt of

request for fire clearance from County Health Department.

D. That any signing should be placed or designed so as not to en-
croach within the public right-of-way or impact the vision of
motorists exiting the drives.
E. That a review of the channelization and striping of Newport
Avenue may be needed for proper left turn access into property.
The applicant shall provide a large scale map, showing all drive-
ways, Wass Street, and Newport Avenue in the immediate area of
the church.
F. That the number of students shall be limited to 35 and the hours
of operation from 7 a.m. to 6 p.m. That any increase in the
hours of operation and number of students shall be requested in
a use permit application.
G. That the sign for the school shall be mounted on existing pole
sign, below existing.cabinet, and shall not exceed 16 square
feet. Colors shall be uniform.
H. That the outdoor' play areas shall be on the north side of the
building, away from the neighboring apartment complex.
