HomeMy WebLinkAboutPC RES 1818 23 25 26 2? 2,9 ~0 ;5'1 ;5,?.. 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 2O RESOLUTION NO. 1818 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, GRANTING A USE PERMIT TO AUTHORIZE THE OP- ERATION OF AN AUTOMOBILE REPAIR FACILITY AT 1011 LAGUNA ROAD. The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application (Use Permit 79-12)was filed by Karl Heinz BadowSki for a Conditional Use Per~ait to authorize the operation of an automobile repair facility on the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detri- mental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use is in conformance with the Land Use Element of the Tustin Area General Plan. 2. The proposed zone is CG and the use is in conformance with that district. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the' neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the develop- ment policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street im- provement requirements as administered by the City Engineer. F. Final development plans shall require the review and approval of the Community Development Department. G. That the project is categorically exempt from the requirements of the California Environmental Quality Act. II. The Planning Agency hereby grants a Conditional Use Permit, as applied for, to authorize the establishment and operation of an automobile repair facility at 1011 Laguna Road (east corner of Newport Avenue and Laguna Road), subject to the following conditions: 1. That the structure will be upgraded to H-4 occupancy in conformance with provisions of the 1976 edition of the Uniform Building Code. 2. That landscaping and irrigation plans'shall be submitted for review and shall include, but not necessarily be limited to the following: a. The existing plant material adjacent to the driveway shall be removed and replaced with lower growing species (3'0" maximum height). 3. The one parking stall shall be provided for the handicap and at least six parking stalls provided in total. 4. That all outside storage of material, supplies, trash, and vehicles in conditions of disrepair shall be totally screened from view. 5. That no outside repair of vehicles or of vehicle components is authorized. 6. That the City approves and adopts an amendment to the zoning ordinance, changing the district to Commercial General. 7. That vehicles under repair, which cannot be adequately stored and screened on site, may be stored on the adjacent oil company development. Such storage must also be screened from view in a method approved by the Community Development Department.
