AN ORDINANCE OF THE CITY OF TUSTIN, CALI-
1 FORNIA, AMENDING THE TUSTIN CITY CODE TO
PROVIDE FOR A LICENSE AND PERMIT BOARD
The City of Tustin, California, does ordain as
follows:
~"" 5 The Tustin City Code is hereby amended by the add-
ition thereto of Article VII, of Chapter 2, being Sections

2-77, et see., which shall read as follows:

Sec. 2-7Z

There is hereby created a License and Permit Board,
10 which shall investigate~ review and issue all licenses
and permits designated to be issued by it, in the manner
11 provided in this Article.
12 .Sec. 2-78. Com,~osition
18 The License and Permit Board 'shall consist of three
members, who shall be appointed by the City Council, and
shall serve at its ~ieasure.
15 Sec. 2-79. Ao'olications and Hearings.
16 The License and Permit Board shall accept applications
uoon forms specified by it for all licenses and permits
1~ t~e authority for issuance of which has been delegated to
the Board. The Board shall make such investigations and
~ 18 reviews of all licenses and permits as it shall see fit,
in. order to review the character, fitness and qualifications
19 of any applicant and to determine the effect on public
health, welfare, peace and safety of such license or permit.
9~0 An applicant, licensee or permittee s!na!i be entitled to
9.1 a hearing before the License and Permit Board upon written
request therefor, and shall be entitled to any such .public
hearing to present all pertinent and relevant evidence
9~9. pertaining to the application. Upon completion of the
investigation and review, the License and Permit Board
~ shall .grant~ deny, revise, suspend or cancel any license
or permit, based upon its review and investigation and-
2~ its determination of the character, fitness and cua!-
ifications of the appl. icant, !icensee or permittes~ and
9'5 a determination of the effect upon public health, welfare,
R6 peace. and safety of the license or permit.
Sac. 2-80. Revocation.
Any license or permit may be revoked or suspended
in any of the following instances:

a) Where the License and Permit Board has found and
~ determined that the preservation of the public
~ 80 health, safety and welfare demand revocation

I b) Where the licensee or permittee has violated any
provision of the Ordinances of the City of Tustin
~ or Statutes of the Sta~e of California or of the
United States of America.
c) Where permit or license has been issued on false or
~ fraudulent evidence, testimony or'application.
~ d) Where the licensee or permittee has violated the
terms and provisions of said license or permit.
No license or permit shall. be revcked or suspended until
said licensee or permittee has had a hearing before the License
and Permit Board, and has had an opportunity to present evidence
on his behalf.
9 Sec. 2-81. Appeal
~0 Any person may appeal a decision of the License and
Permit Board by filing with the City Clerk, within ten days after
11 receipt of notification of a decision of the Board, a written
s~a%emen~ signed by said person stating that he has elected %o
12 appeal to the City Council. The City Clerk shall thereupon set the
matter for hearing before the City Council within thirty days of
~3 the receipt of said notice of appeal. The City Clerk shall mail
the notice to the applicant, notifying him of the time and place
14 of ~he said hearing no~ less than five days prior to said hearing.
At the time of said hearing the City Council shall afford the
~5 applicant an opportunity to present an oral argument to the City
Council. Thereafter the City Council may affirm, reverse, revise
1~ or modify the decision of the License and Permit Board.
The City Council finds and determines that it is necessary
for the preservation of Publi6 Welfare and Safety, that this
Ordinance be adopted as an emergency, urgency Ordinance, to be
effective immediately.
PASSED AND ADOPTED at a Special meeting of the City Council
of the City of Tustin, California, held this 10th day of April,
1967.

City Council of the City of Tustin, California, does hereby
certify that the whole number of the members of the City
Council of the City of Tustin is five; that the above and
foregoing Ordinance was duly and regularly introduced and
read at a regular meeting of the City Council held on the
3rd day of April, 1967, and was given its second reading
and duly passed and adopted as an urgency measure at a
special meeting held on the t0th day of April, 1967, by
the following vote:
