RESOLUTION NO. 18 ! 2
A RESOLUTION- OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN RECOMMENDING THE PRE-ZONING
ON APPLICATION NO. PZ 79-1 OF THE IRVINE/
PETERS CANYON AREA.
The Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency finds and determines as follows:
a. That a proper application, No. PZ 79--1, has been initiated on
the motion of the City Council for a prezone change from the
Orange County Agricultural District to the City of Tustin
Planned Community District for the property bounded by Irvine
Boulevard on the south, the Irvine Company property line on an
alignment with Browning Avenue on the west, the Tustin Sphere
of Influence line on the north and east, westerly of Myford Road and
southerly of the Upper Peters Canyon Reservoir, as depicted by
Exhibit 1 which is incorporated herein by this reference.
b. That a public hearing was duly called, noticed, and held on said
application on April 2, 1979.
c. That an Environmental Impact Report (EIR 78-3) has been prepared
and scheduled for consideration by the City Council on May 7,
1979.
d. That the Planning Agency has reviewed the Draft Environmental Impact
Report and notes the adverse impacts and mitigating measures as
cited within the draft EIR, and EIR 78-3 is recommended for certi-
fication. .
e. That the prezoning should begranted for the following reasons:
(1) The prezoning will establish a mutual understanding between
the land owner, residents of the area, and the City of
Tustin as to potentials for development and enable the land
use planning in advance of preparation of precise development
plans.
(2) The prezoning will enable the development of public works im-
provement plans related to land use development patterns and
circulation requirements.
(3) The subject area is within a flood plain and the prezoning
will enable the application of development standards related '
to flood plain hazards.
(4) The prezoning will enable the Preparation of precise de-
velopment plans to maximize the retention of open Space
and environmental protection.
(5) The proposed prezoning is in conformance with the Tustin
Area General Plan.
f. Development of the subject property at such time as it is removed
from the agricultural preserve shall be in accordance with the
policies as in effect at that time and as adopted by the City
Council, to include Uniform Building Code, Fire codes, street
improvement standards, parkland dedication, energy conservation
requirements, and such other laws and ordinances as adopted by the
State legislature and City of Tustino
g. Prior to the issuance of building permits, a specific plan shall

be submitted to the Planning Agency and City Council for review
and approval. Said plans may incorporate neighborhood designs with
integrated land use patterns to consist of support commercial,
mixed residential, public facilities, and open space. Specific
plans shall conform to the following criteria:
(1) Aggregate residential densities shall not exceed four
dwelling units per gross acre for the total area.
(2) Foothill areas northerly of an alignment with Foothill
Boulevard, as shown by Exhibit 1, shall not exceed a density
of two dwelling units per gross acre.
(3) Site development plans shall accommodate neighborhood.public
and commercial facilities adequate to serve the projected
population densities.
(4) Site development plans shall accommodate parkland and open
space requirements, including incorporation of trail systems
and drainage facilities.
(5) Mitigation measures, as discussed in EIR 78-3, shall be
incorporated into development plans.
(6) Accommodations shall be made for affordable hOusing as may
be required by applicable laws and regulations at time of
development plan approval.
The Planning Agency hereby recommends to the City Council the approval
of Pre zone Application No. PZ 79-1 from the Orange County Agricultural
District to the City of Tustin Planned Community District, subject
to annexation to the City of Tustin and compliance with the terms and
conditions as indicated in paragraph 1 above.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of the
City of Tustin, California, held on the 16th day of April, 1979.
