RESOLUTION NO. 1810
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN, GRANTING A CONDITIONAL USE PERMIT FOR
THE USE OF HAZARDOUS AND NUISANCE POTENTIAL CHEMICALS
AT 14332 CHAMBERS ROAD
The Planning Agency of the City of Tustin does hereby resolve as follows:'
I. The Planning Agency finds and determines as follows:
A. That a proper application (Use Permit 79-7) was filed on behalf
of Chemical Systems, Inc., for a conditional use permit to
allow the use of hazardous materials on the property described
in Exhibit "A" attached hereto and incorporated herein by this
reference as though set forth herein in full.
B. That a public hearing was duly called, noticed and held on
said application.
C. That establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detri-
r..~_ntal to the health, safety, morals, comfort, or general wel-
f=__re of the persons residinq or working in the neighborhood of
such pro?osed use, evidenced by .the following findings:
The use is in conformance with the land use element of
the Tustin Area General Plan.
2. That the hazardous material used in limited quantities can
be used safely when properly handled and stored.
3. That a permit to construct and operate has been granted to
the firm by the South Coast Air Quality Management District.
D. That the establishment, maintenance and opDratlon of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should be
granted.
E. Proposed development shall be in accordance with the development ---
policies adopted by the City Council, Uniform Building Codes
as administered by the Building Official, Fire Code as administered
by the Orange County Fire Chief, and street improvement require-
ments as administered by the City Engineer.
F. Final development plans shall require the review and approval
of the Community Development Department.
II. The Planning Agency hereby grants a conditional use permit, as appli~
for, to allow the use of hazardous and nuisance potential chemicals,
in a manufacturing process at 14332 Chambers Avenue, subject to the
following conditions:
A. That the use of hazardous materials is limited to those sub-
stances and quantities requested in the use permit application:
Isopropyl Alcohol, Acetone'.
B. That the use and storage of hazardous materials shall be limited

to use in those areas of the building, quantities and operation's,
apprOved by the Building Official and Fire Department.
C. That the building and surrounding-site Will be improved as re-
quired by the Uniform Building Code, Uniform Fire Co~e, and
other applicable laws and regulations for such use of hazardous
substances.
D.. That the emission of pollutants (odors, fumes, vapor, s, particulants,i
liquids, etc.) at levels determined to be (1) a nuisance; (2) a
health hazard; (3) a safety hazard, by the City is prohibited.
If any pollution should result, the process causing· the emissions
shall cease until the necessary cleaning devices as determined by
an approved consulting engineer shall be installed in the manu-
facturing process.
That the development should conform to the provisions of' the
Noise Element of the Tustin Area General Plan.
That the development shall conform to all ordinances and regu-
lations governing the Irvine Industrial CompleX.
That the plant-operation shall be in conformance with all rules
=-~.~ regulations of the South Coast Air Quality Management District
~nich includes Rule 402 (Nuisance-Odors) and Rule 442 (Usage
of Solvents).
.5. ~at the use permit is revocable, and may be temporarily suspended
upon reasonable evidence of the violation of any terms hereof or
~mission of any odors creating an annoyance, a nuisance, hazard, or
~!!ution to the adjoining properties in the community, until
such time as corrective action is taken, to the satisfaction of
of the City.
PASSED ~ND ADOPTED at a regular meeting of the Planning Agency held on
the 7th day of May, 1979.
