RESOLUTION NO. 1809
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN, GRANTING A CONDITIONAL USE PERMIT FOR THE
OFFICE DEVELOPMENT OF THE NORTHWEST CORNER OF 17th
STREET AND PROSPECT AVENUE.
The'Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency finds and determines as follows:
(a) That a proper application (Use Permit #79-5) was filed on
behalf of Vista Development for a Conditional Use Permit to
authorize the construction of an office comple~ on the property
described in Exhibit "A" attached hereto and incorporated herein
by this reference as though set forth herein in full.
(b) That a public hearing was duly called, noticed and held on
said application;
(c) That establishment, maintenance and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to. the health, safety, morals, comfort or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
findings:
(1) The use is in conformance with the Land Use Element of
the Tustin Area General Plan.
(2) The use and application request is in conformance with
the Planned Community provisions of the Tustin Zoning
Ordinance.
(d) That the 'establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the subject_
property, nor to the general welfare of the City of Tustin,
~-nd should be granted.
(e) Proposed development shall be in accordance with the develop-
ment policies adopted by the City Council, Uniform Building
Codes as administered by the Building Official, Fire Code as
administered by the Orange County Fire Chief, and street im-
provement requirements as administered by the City Engineer.
(f) Final development plans shall require the review and approval
of the Community Development Director.
2. The Planning Agency hereby grants a Conditional Use Permit, as
applied for, to authorize the development of an office complex on
Planned Community (PC) land at the northwest corner of 17th Street .
and Prospect Avenue, subject to the following conditions:
(a) That 'a continuous 6'8" block wall shall be constructed along
the interior property lines from front setback line on 17th
Street to the front setback line on Prospect Avenue.
(b) That a continuous planting of hedge-like row of trees shall be
provided along the western property line; if needed.
(c) That the second story window detail for the western and northern
building wall shall be designed to permanently obscure the view
into.the neighboring residential properties.
(d) That the trash enclosure shall be located a minimum of 30 feet
from the western property line.

(e) That final plans shall be in conformance with provisions of
City design standards.
(f) That a master sign plan for the complex shall be submitted
and approved by staff prior to issuance of any permanent sign
permits.
(g) Annexation of the subject parcel to the Tustin Lighting District.
Proof of submission of such annexation documents to the County
should be provided the City Prior to final acceptance of pro-
posed improvements..
(h) Installation of Marbelite street lights and underground con-
duit as required by the City Engineer and the Edison Company
"Master Plan Layout."
(i) The developer shall have a civil engineer prepare and/or re-
vise existing improvement plans for Prospect Avenue and 17th
Street (refer to Plan No. R-974) to show the construction of
and shall construct all missing or damaged street improvement
adjacent to said development per the City of Tustin "Minimum
Design Standards for Public Works" and "Street Improvement
Standards."
(j) Payment of sewer connection fees per the Orange County Sani-
ation District No. 7 Ordinance.
(k) Show building connection to existing water and sewer mains.
(1) The driveway on 17th Street should be restricted to right turn
and ingress and egress only.
(m) The electrical and telephone service shall be underground.
(n) A detailed grading shall be submitted for review and approval.
(o) The proposed development may require the ex,cut!on of reci-
procal access agreements upon any future subdivision.
(p) Payment of $50 per tree to the City for planting of trees at
40 feet on center.
(q) All public improvements to be constructed in conjunction
with this development shall be completed prior to the issuance
of any Certificates of Occupancy.
(r) The final site plan should show all public improvements in
Prospect Avenue and 17th Street.
(s) The driveway aprons should be called out on the final plan
to be constructed per City Standard No. 108B.
(t) Placea note on the final plan, stating: NAil work within the
public right-of-way will require a permit from the City of
Tustin Engineering Department."
(u) The developer should be required to dedicate or irrevocably
offer to dedicate the necessary additional 10 and 15 feet of
right-of-way along the corresponding street frontages (10
feet along 17th Street and 15 feet along Prospect Avenue).
(v) 150 feet rear structural setback.
