A RESOLU'T'ION OF THE PLANNING ACErlCY OF THE CITY
OF TUSTIN, GRANTING A CONDITIONAL USE PERMIT FOR
THE USE OF HAZARDOUS MATERIALS AT 14401 CHAMfiERS
A'v ENUE .
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The rlanning Agency finds. and determines as follows:
A. That a proper application (Use Permit 79-6? was filed on behalf
of South Shores Manufacturing, Inc., for a conditional use
permit to allow the use of hazardous materials on the property
Described in Exhibit "A" attached hereto and incorporated
herein by this reference as though set forth herein in full.
B. ':'rat a public hearing was duly called, noticed, and held on
said application.
C. .^at establishment, mai:~tenance and operation of the use zpplied
_o_ will not, under the c.:~.rcu.-~stances of this case, be de~ri-
-ental to tha health, safety, morals, comfort, or general-
~?Ifare of the persons residing or working in the neighborhood
c= such proposed use, evidenced by the following findings:
_. The use is in conformance with the land use element o
the Tustin Area General Plan.
~. That the hazardous material used in limited quantities- can
be used safely when properly handled and stored.
D. ~~~:at the establishment, maintenance and operation of the use
a~aplied for ~,~ill not be injurious or detrimental to the
oroperty and improvements in the neighborhood of the subject
property, nor to the general welfare of the City of Tustin,
and should be granted.
E. Proposed development shall be in accordance with the develog-
ment policies adopted b1~ the City Council, Uniform Building
Codes as administered by the Building Official, Fire Code as
administered by the Orange County Fire Chief, and street
improvement requirements as administered by the City Engineer_
F. Final development plans shall require the review and apgroval
of the Community Development Department.
II. The Planning Agency hereby grants a conditional use permit as
applied for, to allow the use of hazardous materials in a mansfactur-
ing process at 14401 Dow Avenue, subject to the following co:~ditions:
A. That the use and quantities of hazardous materials is limited to
those substances requested in~the use permit application:
acetone, polyster resin, 60o methyl ethyl ketone peroxide.
B. That the use and storage of hazardous materials shall be limited
to use in those areas of the building, quantities and operations
approved by the Building Official and Fire Department.
C. That the building and surrounding site will be improved as
required by the Uniform Building Code, Uniform Fire Code, and
other applicable laws and regulations for such use of hazardous
substances..

D. That the emission of pollutants (odors, fumes, vapors, partic~.~ its,
liquids, etc.) at levels determined to be (1) a nuisance; (2} ~~
health hazard; or (3) a safety hazard, by the-City, is prohibited.
If any pollution should result, the .process causing the emissions
shall cease until the necessary cleaning devices as determined by '
an approved consulting engineer shall be installed in the manu-
facturing process.
E. That the development should conform to the provisions of the
Noise Element of the Tustin Area General Plan_
F. That the development shall conform to alI ordinances arrd regu-
lations governing the Irvine Industrial Complete.
G. That drawing and specifications for the construction of the
dust collector to~ver shall b~ sub::~itted and the appropriate
pew nits c.~ill be applied for. The equipment shall be screer.~d
=ro:n view.

I. Taa~ the plant operation shall be in conformance with all
rules ar_d regulations of the South Coast Air Quality Management
District, which includes Rule 4G2 (Nuisance-Odors); Rule 403
(Fugitive Dust}; Rule 442 (Usage of Solvents); and Rule 48I
iSpray Coating Operations;.
~. That the use permit is revocable, and may be temporarily sus-
pended upon reasonable evide:-_ce of thQ violation of any terr~.s
hereof or emission of any odors creating an annoyance, a
n~sisance, hazard, or pollution to the adjoining properties
in the community, until such time as corrective action i.s
taken, to the satisfaction of the City.
