RESOLUTION NO. 1806
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING USE
PERMIT 79-4 FOR CONDOMINIUM CONVERSION OF
FULLER GARDENS APARTMENTS.
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines:
A. That a proper application has been filed by Quail. Place Develop-
ment Corporation for the condominium conversion of the Fuller
Gardens Apartments at 17522 through 17574 Vandenberg Lane, on the
property described in Exhibit "A" attached hereto and incorporated
herein by this reference as though set forth herein in full;
B. That a public hearing was duly called~ noticed and held on said
application;
C. That establishment, maintenance and operation of the rise applied
for will not, under the circumstances of this case, be detrimental
to the health, safety, morals, comfort, or general welfare of the
persons residing or working in the neighborhood of such proposed
use, evidenced by the following findings:
1. That said deVelopment is in COnformance with Land Use and
Housing Element of the Tustin Area General Plan.
2. That said development is in conformance with the Planned Develop-
ment (PD) standards of the Zoning Ordinance.
D. That the establishment, maintenance and operation of the use applied
for will not be injurious or detrimental to the property and im-
provements in the neighborhood of the subject property, nor to
the g~-neraI welfare of the city of Tustin, and should be granted,
E. Preposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
a~inistered by the Building Official, Fire Code as administered by
O~=nc~~_ .~ County Fire Marshal, and street improvement requirements
as administered by the City Engineer.
F. Final development plans shall require the review and approval of the
Com_munity Development Department.
II. The Planning Agency hereby grants a Conditional Use Permit, as applied
for, to authorize the conversion of 100 apartment units to i00 condo-
minium units, subject to the following conditions:
A. That a tentative tract map and final tract map shall be submitted to
and approved by the City for recordation~with the following con-
ditions required as part of any approval:

1. The developer shall have a divil engineer revise existing im-
provement plans for Vandenberg Lane (refer to Plan No. RS-864)
to show the construction of ~nd shall construct all missing or
damaged strec~ improvement adjacent to said development per
the City of Tustin "Minimum Design Standards of Public Works"
and "Street Improvement Standards."
2. Ail public improvements to be constructed in conjunction with
this development shall be completed prior to the final in-
spection and release by the Building Department.
3. A detailed grading plan, showing the disposition of all drain-
age, shall be submitted for review and approval.

4. Installation of all utilities underground in connection with
this development, with no poles being set either on or adjacent
to the subject development.
5. The formation of a "Community Association" to provide for the
maintenance of the common area.
6. The developer shall submit conditions, covenants, and re-
strictions to the City Attorney for review and approval.
7. The developer shall provide,.to the satisfaction of the City,-
sufficient information to show that the proposed development
will not interfere with the existing flood control channel.
~B. That the existing tenants be notified of the proposed conversion
to condominin~m Knits and a relocation program be prepared by the
developer and approval by the Planning Agency.
C. That the structures and grounds be rehabilitated as necessary for
appearance and to conform with appropriate development ordinances
and regulations.
D. That the condominium conversion shall comply with the requirements
and intent of the development regulations and code requirements
as adopted by the City of Tustin, including but not limited to
the following:
1. Sound attenuation be provided in a manner specified by an
acoustical engineer as approved by the Building Official to
satisfy the intent of Ch~ter 35 of the Uniform Building Code
1976 Edition and of California Administrative Code Title 25,
Chapter 1, Subchapter 1, Article 4.
2. Compliance with the Security Ordinance to provide deadbolt
lockk, window locks, security lighting and those other items
required by staff to meet the intent of the ordinance.
3. One-hour rated fire walls shall be provided between units and
compliance with all Fire Marshal's requirements to meet fire
safety standards. Fire detection devices shall be provided for
all units and residential fire sprinkler system for those units
as directed by the Fire Marshal.
4. Electrical system shall be inspected and upgraded if determined
necessary by the Building Official.
5. Compliance with City Sign Code.

6. That all roofs shall be repaired to conform with moisture pro-
tection provisions of the Uniform Building Code.
E. That the parking structure shall be modified in design to prevent
any detriment to the surrounding or on-site residential units.
F. That the wal~ay system at the rear of the site shall be designed so
as to accommodate emergency vehicles.
G. That the CC&Rs will include, but not be limited to, disclosure of
management agreements, maintenance provisions, access for emergency
repairs, easements, etc. so future purchasers will be aware of
some problems which might occur.
H. That a perpetual easement shall be provided for all utilities (sewer,
water, telephone, gas, electricity, heating, and airconditioning,
etc.)
