RESOLUTION NO. 1804
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING A CONDITIONAL USE
PERMIT ON APPLICATION NO. 79-2 OF YOSHINOYA
WEST, INCORPORATED.
The Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency of the City of Tustin finds and determines:
a. That a proper application (UP-2) was filed on behalf of Yoshinoya
West, Incorporated for a conditional use permit to authorize the
construction of a drive-through restaurant and site improvements
for the overall Parklane Shopping Center located at the southeast
corner of Newport and Walnut.
b. That a public hearing was duly called, noticed, and held on said
application.
c. That this application is subject to compliance with requirements
of the California Environmental Quality Act.
d. That establishment, maintenance, and operation of the.use applied
for will not, under the circumstances of this case, be detrimental
to the health, safety, morals, comfort, or general welfare of the
persons residing or working in the neighborhood of .s. uch proposed
%/se.
e. The land use is in conformance with the Tustin Zoning Code.
f. _~nat the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property .
and improvements in the neighbOrhood of the subject property, nor
to ~he general welfare of the City of Tustin, and should be granted.
g. Proposed development will be in accordance with the development
policies as adopted by the City Council.
h. Fi~na! development plans shall require the review and approval of
the Community Development Director.
2. The Planning Agency hereby grants a conditional use permit, as applied
for, to authorize development of a drive-through restaurant and
renovation of the Parklane Shopping Center, subject to the following
condit ion s:
a. Drive-through restaurant shall be designed to provide adequate
parking and car stacking in drive-through lane.
b. A master sign plan shall be prepared by the applicant and approved
by the Planning Agency prior to the issuance of permits.

c. Color and material boards shall be submitted for Agency approva~
to insure the compati~bility of colors and materials for the
restaurant and overall Center renovation.
d. Parking lot changes shall include the landscaping and restrip'~g
of the shopping center per the applicant's revised site plan
and as approved by the Agency staff.
e. Trash enclosures shall all be enclosed, to the rear of the Center,
and employee's parking shall be designated in the rear and sides
of the shopping center.
f. Ail parking lot improvements shall be completed prior to the
occupancy of the restaurant.
g. kpplicants shall post a bond to insure completion of the overall
shopping center improvements within a period not to exceed ninety
(90) days after the opening of the restaurant.
h. Compliance with Planning Resolution No. 1688.
i. Compliance with all requirements of the applicable City and State
Codes, as administered by the Community Development Department
and Orange County Fire Marshal.

j. Compliance with all Engineering requirements which include:
(!) Dedication of additional ten (10) feet of rig~-of-way along
Walnut, with a corresponding cOrner cut-off at Newport Avenue.
(2) The developer shall have a civil engineer revise existing
improvement plans for Walnut and Newport Avenues to show the
construction of and shall construct all missing or damaged
street improvements adjacent to said development per the
City of Tustin "Minimum Design Standards of Public Works"
and "Street Improvement Standards."
(3) .All public improvements to be constructed in conjunction with
this development shall be completed prior to the issuance of
any Certificates of Occupancy.
(4) A detailed grading plan, showing the disposition of all
drainage, shall be submitted for review and approval.
(5) Payment of sewer connection fees per the Orange County
Sanitation District No. 7 Ordinance.
(6) Payment of $50 per tree to the City for planting of trees at
forty (40) feet on center.
(7) The driveway aprons should be called out on the final plan
to be constructed per City Standard No. 108B.

(8) Installation of Marbelite street lights and undergrotu~d
conduit, as required by the City Engineer and the Edison
Company "Master Plan Layout."
(9) Installation of all utilities underground in connection with
development of Parcel 1 with no new poles being set either~'
on or adjacent to subject development.
(10) Place a note on the f~nal plan, stating "all work within the
public right-of-way will require a permit from the City of
Tustin Engineering Department."
(11) Recordation of a reciprocal access easement b~tween Parcels
1 and 2 for the drive entrance, near the easterly corner of
Parcel 1.
(12) The developer shall record with the County Recorder an agree-
ment between Parcel 1 and Parcel 2 to allow vehicles parked
along the southwesterly property line to encroach on Parcel 2.
