MINUTES
REGULAR MEETING
TUSTIN PLANNING COMMISSION
JANUARY 10, 2012
7:00 p.m. CALL TO ORDER

PUBLIC CONCERNS:
Kal Patel stepped forward to present his concerns regarding the
progress on the Express Car Wash project at 3017 Edinger
Avenue. Mr. Patel stated his general concerns involve the
applicant making changes to the project which do not fall under
his current conditions of approval. These changes include
eliminating the "self-serve" portion of the carwash which will now
require an employee to monitor the cash-flow, adding an
additional 300 square feet of building area with no parking
impact conducted, and converting standard parking stalls into
vacuum stations. Mr. Patel requested that the progress on the
project be regulated to ensure fair treatment of business owners
with similar investments throughout the city.
The Director stated staff will follow-up with Mr. Patel and report
back to the Planning Commission at an upcoming meeting.
Mr. Patel thanked the Commission and staff for their time and
genuine concern and interest in considering his request.

CONSENT CALENDAR:
Approved 1. APPROVAL OF MINUTES -NOVEMBER 08, 2011, PLANNING
COMMISSION.
Motion: It was moved by Puckett, seconded by Kozak to move the Consent
Calendar. Motion carried 5-0.

REGULAR BUSINESS:
Received and filed 2. PLANNING COMMISSION AND COMMUNITY
DEVELOPMENT DEPARTMENT SUMMARY - 2011 YEAR IN
REVIEW.
Throughout the year, staff provides the Planning Commission
with a status of projects that the Planning Commission,
Zoning Administrator, or Community Development Director
approved; major improvement projects; and other items of
interest. The Planning Commission and Community
Development Department Summary - 2011 Year in Review
briefly describes the total number of discretionary permits
{i.e. Conditional Use Permits, Design Reviews, Subdivision
Maps, etc.), major accomplishments for various functional
areas within the Community Development Department,
Code Enforcement, and Building Division activity.
RECOMMENDATION:
That the Planning Commission receive and file the report.
The fallowing staff presented the Year in Review report:

Willkom Provided the Commission with supplemental information regarding the
OC Parks North Hangar Project.
Bobak Provided an update on the status of redevelopment agencies
throughout the state. Stated that the California Supreme Court
recognized the significance of this issue through accepting review of the
case immediately, and placing it on an expedited review schedule.
Cities do not have the opportunity to use tax increment funds to keep
their redevelopment agencies. Redevelopment projects in progress will
be allowed to be continued by a successor agency, such as the City.

Bobak cont... There is the possibility of placing another measure on the ballot which
will make redevelopment agencies part of the California Constitution so
the legislature will not be able to take them away.
Planning Commission questions/discussion generally included the
location of a majority of the filming activities discussed in the report,
availability of funds for the energy efFiciency permit fee rebate program,
the success of the shopping cart containment program, status of
redevelopment throughout the city, detail on wireless applications in
progress, and status updates on the new OCFA station and Tustin
Ranch Road projects. The Commission thanked staff for their work
throughout the year.
The report was received and filed.
STAFF CONCERNS:
3. REPORT TO THE PLANNING COMMISSION ON CITY
COUNCIL ACTIONS.
A report will be provided to the Planning Commission on
matters taken before City Council. Included are the action
agendas for the City Council meetings held on November 15,
2011, December 6, 2011, and January 3, 2012; and the
Special Meeting of the City Council action agenda for
November 15, 2011.
The Director reported on City Council actions as follows:
• Had a second reading and adopted the Body Art Ordinance
pursuant the Planning Commission's recommendation;
• Denied the Walgreens Code Amendment regarding alcohol
beverage sales;
• Considered and approved two Mills Act request on "B" and
Pacific Streets;
• Considered a report related to the adoption of a High Fire
Hazard Severity Zone map. Information regarding this item will
be brought before the Planning Commission at an upcoming
meeting.
The Director additionally reported:
• Any information related to the status of the City of Tustin's
Redevelopment Agency will be provided to the Commission to
keep them aware of the situation at hand;
• Extended a welcome to the City's new City Manager, Jeff
Parker.

COMMISSION CONCERNS:
Moore Stated it is great to be back, and wished his fellow
Commissioners and staff a Happy New Year.
Kozak Attended the Mayor's Thanksgiving Breakfast, the City Council
Meeting in which Mayor Nielsen and Mayor Pro Tem Murray
were selected, the City of Tustin Christmas Tree Lighting, and
two webinars provided by the California Preservation
Foundation;
• Congratulated Mayor Nielsen and Mayor Pro Tem Murray;
• Welcomed City Manager Jeff Parker to the City;
• Thanked staff for their hard work during the year 2011, and looks
forward to continuing to work alongside them to serve the City
and community during 2012.
Eckman Attended the City of Tustin Tree Lighting Ceremony, thanked the
Parks and Recreation Department for putting on the event;
• Gave a special thanks to the Tustin Police Department
volunteers who take Santa's sleigh around the neighborhoods of
Tustin. Stated his neighbors look forward to the event every
year, and they hope it will continue for many years;
• Hopes there is a back-up plan for the City to cope with the
dissolving of redevelopment agencies throughout the state;
• Thanked staff for their work this evening and throughout the year
2011.
Puckett • Congratulated Mayor Nielsen and Mayor Pro Tem Murray.
Stated they got proper training from serving on the Planning
Commission in the past;
• Congratulated the Tustin High School Football team on their CIF
Championship. Added that his alma mater, the Pittsburgh State
Gorillas, won the NCAA Division 2 Championship last year, and
congratulated them on their win;
• Congratulated George Vallevieni, Chief Jordan, and the entire
Police Department staff and volunteers on a great jab with the
Santa's sleigh program;
• Added that retired Police Captain Mike Shanahan, who is now a
Reserve Officer, volunteered many hours to this program and
was honored as Yorba Linda Man of the Year last year;
• Reminded everyone that the Mayor's Inaugural Dinner is coming
up on February 2, 2012;
• Welcomed Jeff Parker and stated he looks forward to meeting
him;
• Was disappointed due to the lack of Commission meetings
during the month of December, and took the liberty of wearing a
holiday tie at this evening's meeting;

Puckett cont... . Wished everyone a Happy New Year and thanked staff for their
work.
Thompson . Attended an OCTA Citizen's Advisory meeting and provided an
update to City Council;
• Stated there are heavy construction projects being conducted by
OCTA and it is good to see that OCTA is funding projects and
creating jobs for the community;
• Enjoyed the Mayor's Thanksgiving Breakfast;
• Was honored by OCBC with a partnership award in collaboration
with the County of Orange and CalTrans; thanked the Board of
Supervisors for the award;
• Congratulated Mayor Nielsen and Mayor Pro Tem Murray;
• Welcomed Jeff Parker and gave a special thank you to former
City Manager Bill Huston for filling in as Interim City Manager
during the selection process;
• Thanked Christine Shingleton for her continued service to the
City;
• Thanked staff for the information provided on the California
Preservation Foundation webinar regarding architectural styles,
shared it with many colleagues and friends;
• Lastly, wanted to congratulate and wish his wife Cherie
Thompson a Happy 26t" Anniversary.
8:19 p.m. ADJOURNMENT:
The next regular meeting of the Planning Commission is scheduled
for Tuesday, January 24, 2012, at 7:00 p.m. in the City Council
Chamber at 300 Centennial Way.
