RESOLUTION NO. 1787
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN SETTING FORTH FINDINGS THAT A SCHOOL MAY BE
PERMITTED TO OPERATE UNDER CONDITIONS OF A USE PERMIT
PREVIOUSLY GRANTED TO A SCHOOL OF SIMILAR CHARACTER.
The Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency finds and determines as follows:
a. That Section 5.2 of Ordinance 157 (Zoning Ordinance) provides that
if any ambiguity arises concerning the appropriate classification of
a particular use within the meaning and intent of this chapter, of
with respect to matters of height, area requirements or zone
boundaries as set forth herein, the Planning Commission shall
ascertain all pertinent facts and by resolution set forth its
findings and interpretations and thereafter such interpretations
shall govern, except if the City Council of Tustin directs the
Planning Agency to adopt a different interpretation.
b. That the Planning Agency at their meeting of November 20, 1978
did ascertain all pertinent facts relating to the appropriate
regulations and use conditions of schools and instructional op-
erations.
c. That schools are permitted in the Central Commercial District (C-2)
subject to. a use permit.
d. That schools specializing in the instruction of different subjects
and disciplines may operate in a similar manner and therefore the
special conditions required to safely operate different schools
at a. specific location could be the same.
2. The Planning Agenc-y~, therefore, finds that a school may be authorized
to operate under conditions of a use permit previously granted to a
school of similar character (size, type of students, hours of oper-
ation) at the same location subject to review and approval by the
Planning Agency.
PASSED AND ADOPTED at a regular meeting of the City of Tustin Planning Agency
held on the 4th day of December, 1978.
