HomeMy WebLinkAboutPC RES 17866 8 10 11 20 Zl 24 ~8 RESOLUTION NO. 1786 A RESOLUTION OF THE PLANNING AGENCY RECOMMENDING TO THE CITY COUNCIL AMENDMENTS TO THE CITY CODE TO PROVIDE FOR THE REGULATION OF STOCK COOPERATIVES The Planning Agency of the City of Tustin does hereby resolve as follows: 1. The Planning Agency finds and determines the following: That the Planning Agency has initiated amendments to the Zoning Ordinance (Ordinance No. 157, as amended) to provide' for the regulation of Stock Cooperatives. B. That a public hearing was duly called, noticed, and held on said amendments. C. That the proposed amendments are necessary for the con- venience of the public and the orderly development of private properties. 2. The Planning Agency hereby recommends to the City Council following amendments: A. The Tustin City Code is hereby amended by the amendment of Section 9321 to read as follows: a. A tentative and final map shall be required for all subdivisions creating five or more condominiums, as defined in Section 783 of the Civil Code, or a com- munity apartment project, as defined in Section 11004 of the Business and Professions Code, containing five or more parcels, or a stock cooperative as defined in Section 11003.2 of the Business and Professions Code, containing five or more parcels, except where: (1) The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedications or improvements are required by the City Council, or (2) Each parcel created by the division has a gross area of twenty (20) acres or more and has an improved access to a maintained public street or highway, or (3) The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of the tract of land zoned for industrial or commercial development, and which has the approval of the City Council as to street alignments and widths, or (4) Each parcel created by the division has a gross area of forty (40) acres or more. b. A parcel map shall be required for those subdivisions described in subparagraphs (a) (1), (2), (3), and (4) above. B. The Tustin City Code is hereby amended by the amendment of Section 9322 to read as follows: 2 4 10 11 12 13 14 18 19 2O 21 22 23 24 25 26 27 28 29 30 31 ;52 CONDOMINIUM PROJECT, COMMUNITY APARTMENT AND STOCK COOPERATIVES (a) A tentative and final map shall be required for a condominium project, community apartment project, and stock cooperative project, and fees shall be im- posed on the basis of the parcel or lots of the surface of land shown thereon as included in a project, in- cluding those parcels or lots shown in common ownership. (b) Tentative and final maps for initial construction or conversion of the existing structures or residential occupancy shall conform to the criteria of the Zoning Ordinance for the Residential Plan Development (RPD) District. C. The Tustin City Code is hereby amended by the addition thereto of Item 8 to subsection b of Section 9224 to read as follows: 8. Stock Cooperatives as defined by Section 11003.2 of the Business and Professions Code. D. The Tustin City Code is hereby amended by the amendment of Item (4) to subsection g to Section 9224 to read as follows: (4) Minimum G-ross Floor Area (a) The following uses shall be subject to the following minimum square feet of gross floor area per unit exclusive of garages, carports and unenclosed porches and patios Bachelor Units: One Bedroom Units: Two Bedroom Units: 450 square feet 650 square feet 800 square feet (b) For each additional bedroom in excess of two bedrooms in a unit, there shall be an additional 100 square feet of gross floor area.
