A RESOLUTION OF THE PLANNING AGENCY OF
THE CITY OF TUSTIN, CALIFORNIA, GRANTING
A CONDITIONAL USE PERMIT FOR 27 RESIDEN-
TIAL CONDOMINIUM UNITS FOR THE PROPERTY
AT 422 W. FIRST St.
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a. That a proper application was filed on behalf of
Jansvu Properties for a Conditional Use Permit to
authorize the construction of 27 residential condo-
miniums on the property described in Exhibit "A"
attached hereto and incorporated herein by this
reference as though set forth herein in full;
b. That a public hearing was duly called, noticed and
held on said application;
c. That establishment, maintenance and operation of the
use applied for will not, under the circumstances
of this case, be detrimental to the health, safety,
morals, comfort or general welfare of the Dersons
residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
(1) the use is in conformance with the Land Use
Element of the General Plan
(2) the use is in conformance with the Zoning
ordinances (PD) , as amended;
d. That the establishment, maintenance and operation of
the use applied for will not be injurious or detri-
mental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should
be granted.
e. Proposed development shall be in accordance with the
development policies adopted by the City Council,
Uniform Building Codes as administered by the Buildir
Official, Fire Code as administered by the Orange
County Fire Marshall, and street improvement require-
ments as administered by the City Engineer.
f. Final development plans shall require the review and
approval of the Community Development Director.
2. The Planning Agency .hereby grants a COnditional Use
Permit, as applied for, to authorize the construction of 27 residen-
tial condominiums subject~.to the following conditions:
a. The development shall conform as needed, and satisfy
all conditions of City Council Resolution Nos. 76-14C
(General Plan Amendment), and 78-58 (Tentative Tract)
and the City Ordinance No. 758 (Rezone).
b. The structures shall be provided with an automatic
residential fire sprinkler system to be approved by
the Orange County Fire department.

c. Two (2) on-site fire hydrants capable of delivering
2500 gpm shall be provided at locations approved by
the Orange County Fire Department.
d. No second story windows will be provided within
fifty (50') feet of the property lines which abut
R-1 zoned properties.
e. The location of the trash enclosures must be approve
by the City's franchised refuse collection service.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency of the City of Tustin, California, held on the 2nd day of
October, 1978.
